Osmani accuses of Ljubljana pose danger, the Special Prosecutor rejects her claims

The Special Prosecutor of the Republic of Kosovo (PSRK) has not accepted any reports, information or denouncing from the Kosovo Agency for Intelligence (AKI), Kosovo Police, the Ministry of Internal Affairs or anyone else, through which it could be claimed that Constitutional Court Judge Radomir Laban could be a danger to the national security of the Republic [...]
So has confirmed the <x0th Justice Vow, Arbnor Luta, official for public communication at the PSRK.
We inform you that, according to the Special Prosecutor's Register, no case of the person you have addressed questions about has been recorded. The prosecution remains committed to combating crime, corruption and protecting public interest, acting in accordance with law and justice principles”, Luta's response is said.
President Vjosa Osmani and former Justice Minister, now Deputy Speaker of the Parliament Albulen Haxhiu through some statements, have raised doubts that Judge Laban may be a danger to the country's national security.
Initially, on August 5th 2025, President Osmani, at a media conference, announced that he has withdrawn the application submitted to the Constitutional Court to clarify the judicial consequences in the event of non-compliance of the Parliament within the deadline set by the Constitution. That decision, Osmani said, was taken after it was announced that the reporting judge of the case has been appointed Radomir Laban.
The president said that for Laban's dangerous activity, institutions had sent official information, which are also shared with the Constitutional Court.
The “announced that today in accordance with the Law for the Constitutional Court, as well as in accordance with the rule of this Court, I have withdrawn the request KO215/25. I have done this as an immediate response to the already confirmed information that as a reporting judge in this request, Judge Radomir Laban has been appointed, for whose dangerous activity in 2018, 2021 and 2024, our security institutions have submitted clear and official information. According to these information, which in 2021 and 2024, have also been shared with the Constitutional Court, this judge poses a danger to the national security of the Republic of Kosovo and is engaged in activities against the constitutional order of the Republic of Kosovo”, Osmani had said.
At that conference, the president said that a year ago they have also officially raised the issue of accepted information concerning the danger Laban poses for the country's constitutional order. For this information, she said the Ministry of Justice had refused to appoint Laban to the position of swimmer.
I consider that the appointment of Judge Radomir Laban as judge in this process is not only disturbing, but dangerous. Since decisions can be made that can create serious and potentially irreversible consequences not only for current institutions but also those in the future”, Osmani said.
She said this judge was appointed in 2018 and that the dismissal of a judge only takes place after being voted in 2/3 of the judges, which is then proposed to the president.
“Therefore, attracting this requirement is the necessary act in the defence function of constitutional order. It is absurd to expect our constitutional order to be protected by exactly persons who, according to our security institutions, ensure the constitutional order of our country”, Osmani had said.
Osmani also said reports of 2021 and 2024 speak of Laban's activities dealing with endangering the constitutional order of the Republic of Kosovo and endangering the national security of the Republic of Kosovo.
A day later, on August 6th 2025, now former Justice Minister Albulen Haxhiu said that at the time the judge was issued at the Constitutional Court, Radomir Laban, by former President Hashim Thaci, the Vetevendosje Movement had demanded that he be dismissed. According to her, because of his criminal past.
But according to her, in official response to this request they were told they were making interference in their independence,
“When in 2018, former President Thaci had ignored our calls not to decree Radomir Lyban as Constitutional Court judge, because of his criminal past and given that the Constitutional Court judges are dismissed by the president but in advance with the proposal of 2/3 judges of this court and not by any other organ, we had addressed an official request to former Constitutional Court President Arta Rama-Hajriz, calling for the launch of procedures for his dismissal. However, instead of taking this request into account, we had accepted an official response in which our request was said to constitute intervention in their independence”, Haxhi wrote.
Even at a media conference on August 10th 2025, Haxhiu said that Judge Laban is suspected to be “associate with Serbia's Agency for Security and Information BIA”. He said the allegations are based on information she has from Kosovo security institutions.
“With the financial means and real estate it gets today from Serbia, Ljubljana poses a threat to Kosovo's security and constitutional order”, it said, among other things.
Even on 9 September 2025, when announcing comments sent to the Constitutional Court on the issue raised by the Serbian List for voting by minority deputy leaders, President Osmani said that the fact that Radomir Laban continues to be Constitutional judge would have to pose concern for all.
To these statements, the Constitutional Court had reacted, saying its judge, Radomir Laban, was appointed in 2018 after being subjected to “all constitutional and legal procedures”, for his proposal by the Kosovo Assembly and the decree by the president of Kosovo. /Periscopi/
