The decision comes as Trump seeks to use the National Guard troops to crack down on crime in other US cities and to support implementation of the immigration law, reports the BBC.
Trump deployed troops of the National Guard in Los Angeles in June in response to protests against immigration raids.
American District Judge Charles Breyer decided on Tuesday the way the government had used troops to violate the Posse Comitatus Act, which limits the federal government's power to use military force in internal affairs.
He postponed the decision until 12 September, and Trump will likely appeal. /Periscope
