D.N. Serbia's nationals, accused of being commander of the Jäger police substation in Gjilan, had taken no action to prevent the killing of 13 members of the Hyseni family and Shaban family at the Hyseni family home.
There is a doubt that defendant D.N. in the quality of the German Police Substation Commander, violating international law rules, Article 86 and 87 of the additional protocol of 1977, the Geneva Convention of 1949, acting in command responsibility, had taken no action to prevent or punish the perpetrators of crimes committed against that village's civilian population by Serb forces and Serbian paramilitary, carried out by the defendant S.A., where 13 members of the Hyseni family and Shaban were killed at the Hyseni family home. Although it was announced through a letter from the injured D.H. and I.H., the defendant has been forced to take action within his competencies, as the commander of that substation, the same has left the site without taking necessary and reasonable measures to prevent, ban, or present cases for investigation or criminal prosecution, and thus has been reconciled to the cause of harmful consequences, and these actions are confirmed by statements of injury and witnesses, from which evidence even that the defendant of DN. He was commander of the Jäger police substation, at the time of the conduct of criminal work”, the report said.
The court estimated that the burden of a criminal offense is of a serious and complex nature, so the appointment of the detention measure is necessary in this criminal case and that any other measure would be insufficient for successful implementation of the criminal procedure. /Periscope/
