Hasan: Basha's words have no legal consequences, Osmani has the right to grant a mandate to someone if the Parliament is enforced by law

Former Constitutional Court Chairman Enver Hasani has stated that the RS List complaint to the Constitutional issue of selecting the deputy heads of the Parliament, according to all odds, is based. The court must decide now. I guess it won't take long, of course not more than 60 days. It will decide whether the request of the Serbian List is based. At first glance I think it is clearly based, because the Constitution, three decisions and regulations say that the assembly is constitutionalised only when all the deputy leaders of the Albanian community, the Serb community and non-Albanian and non-Serb communities are elected, because they also have guaranteed seats”, he said.
According to him, if President Osmani mandates someone to form the government, it commits constitutional violations.
I cannot imagine a situation where it does not end up in court for violating the constitution, because it is a clear violation of the Constitution. It has no right to give a mandate to anyone unless the assembly is constitutionalised according to the law and under the orders and decisions of the Constitutional Court of Kosovo”, he said.
On Saturday, although not elected Serbian deputy chairman, Parliament Speaker Dimal Basha announced the constitutionalisation process closed. He called a leadership meeting yesterday, which failed because the LDK did not go.
Hasan says what Basha has said does not produce any consequences.
What he said has no legal consequences. It is invalid in the absolute sense because the Assembly is constitutionally constituted only if all vice-presidents are elected, as the Constitutional Court of Kosovo has ordered in an act of judgment in 2014, and in two judgments this year. They have interpreted the constitution, and the constitution is clear when it rates the structure of the Parliament and the composition of the” Assembly has said Hasani for Euronea in the Serbian language.
Hasan has also stressed that the ruling party (VV) is interpreting the Constitution dogmatically, stressing that this dares not be so, “because according to that logic no non-Albanian community can ever elect their vice-presidents because they don't have 61 votes”.
According to Hasan, it is up to the court to decide on the modalities that should follow the Parliament on constitutional terms, the election of two vice-presidents from the Serb and non-Albanian community, respectively. /Periscopi/
