The European Union has called on political actors and Kosovo institutions to refrain from “any inappropriate intervention” in the work of the Constitutional Court, which has recently been criticised by incumbent Prime Minister Albin Kurti, and his party officials. A European bloc spokesman told Free Europe Radio on Friday that “the Constitutional Court is to interpret and ensure respect for the Kosovo Constitution”, follows Periscope.
The “is the task of all political actors and Kosovo institutions to respect this role and refrain from any form of inappropriate interference in the work of the judiciary and the Constitutional Court, including through personal attacks”, the spokesman said.
In recent days, Kurti ʹ, who is also leader of the Vetevendosje Movement and other party officials, including Deputy Chairman Glauk Konjufca, have criticised the Constitutional Court for bias, saying it is close to Albanian parties that the previous mandate was in opposition.
“Through our mandate that s) is about to end and the new mandate being launched, honoured delegates to the General Council of Movement V We know there is a Constitutional Court that is functioning as a political shadow of the opposition to the V There was Tell Kurt at the meeting of the LVV General Council on September 7th.
The only dilemma I have in this situation is whether it's more absurd, or more harmful, this 25-day measure. But, which is both absurd and very harmful, I have no doubts”, he stressed.
Kurti was talking about the Constitutional's most recent decision, which last week imposed temporary measures that prevented the elected MPs from taking action and prevented them from developing any procedure for forming the new government.
The court imposed this measure, which will be in force on September 30th, ex ex ex officio and on the request of Serbian List deputies.
The largest party of Kosovo Serbs believes constitutional violations have been committed after the new head of the Parliament, Dimal Basha, from LVV, has put the candidates for vice-presidents of the Parliament by non-Serb and Serb minorities in the polls.
The Serbian list, which in the Assembly has 9 of the 10 seats reserved for Serbs, insisted on proposing only Slavko Simi, even after he failed to get the 61 votes needed after the three allowed rounds of voting.
When she refused to propose to someone else for deputy chairman, Basha decided to cast lots, according to the Parliament's work regulation, to draw another name from the Serb community.
In addition to all MPs from the Serbian List, Nenad Rassic was nominated for the post by the Serbian Party for Freedom, Justice and Survival, who is also acting minister in Albin Kurti's government. Rassic did not get the necessary votes either.
Together declared the constitution unilaterally binding, despite the lack of a fifth deputy chairman.
Meanwhile, the country's president, Vjosa Osmani, has sent comments to the Constitutional Court early in the week, and has said that the functioning of the Kosovo Parliament should not be blocked by the lack of a deputy chairman, criticising the Serbian List that however “synon” would block the formation of the country's institutions.
Osmani said that in her comments, she has asked the Constitution not to allow anyone to have veto rights to the country's important processes.
On Monday, the Constitutional Court said it feels concerned with “the reckless declaration” of senior state officials and political elected.
Through a response, the Constitution said that its independence and impartiality are protected by the Constitution and no “institution, political or individual parties can interfere in its work”.
The EU spokesman told the REL that it is up to all political parties to resolve the political stalemate, adding that they “can avoid getting away with dialogue and compromise, overcome institutional deadlock and preserve Kosovo's democratic and multiethnic character”.
Even the German Embassy in Pristina called at the beginning of the week on political actors and institutions to respect the Constitutional Court and refrain from attacks on it.
