The court issued a warrant for commitment to Svecla, Pacoli-Dalip and Zyba- session expected to be held in October

This ordinance was issued after Svechla, Zyba and Pacolli-Dalip missed the September 16th 2025 session. For the three accused, Judge Sabit Sadij said at that hearing they were invited according to the preliminary session's findings and there was no request for postponement of the session, reports “Battle for Justice”, broadcast Periscope.
In a response to “Justice Vow“, the Constitutional Court in Pristina confirmed that the ordinance issued by Judge Sadiki should be executed by Kosovo Police and the accused brought to the session on October 31st 2025.
“at the 1609.2025 trial hearing, defendants F.P.D., S.Z., and J.S. Even though they were invited to the preliminary hearing procession, the same have been missed at the hearing, while the absence has not reasoned. The judge of this criminal case, Sabit Sadij, based on such a state of fact, outside of the 1809.2025 session has issued the ordinance for binding conduct against defendants F.P.D., S.Z., and J.S., and has ordered the Kosovo Police to take appropriate actions so that further procedure can be taken by the court and imposed on this penal-juridic case. The ordinance will be executed by Kosovo Police, so that the three defendants must be brought to court by the date 3110.2025 at 10,00”, the tribunal's response said.
The Constitutional Court in Pristina on June 6th, 2024 has confirmed the indictment of Svecla, Milak, Zyba and Pacolli-Dalip for dropping tear gas in the Assembly in March 2018. The Foundation's decision, however, was later confirmed by the Court of Appeals.
Unlike the initial session held on March 26th 2024, the four accused had been acquitted of dropping tear gas in the Assembly.
Minister Svecla and the three deputies, Millaku, Zyba and Pacolli-Dalip were also charged with criminal acts “Pegim of the official person in performing official duties”, but for this work at the initial session of Sabit Sadikuj case, the judge had announced he reached the absolute prescription of prosecution.
In October 2021, he had reported exclusively on the indictment filed with Minister Svechla and MPs Milaku, Zyba and Pacoli-Dalip.
According to the indictment provided by “Justice Vocation”, which turns up on July 29, 2019, Svechla, Milaku, Zyba and Pacoli-Dalip are charged that on March 21, 2018, around 12:10 until 15:40, several tear gas canisters had been fired into the Kosovo Assembly Hall, where the plenary hearing was being held.
It says that as a result, all MPs had been forced to free the House of Parliament, with what cases they could not continue the session.
With this, each alone is accused of committing criminal work “the use of weapons or dangerous tool” by Article 375, paragraph 1 of the Penal Code, whose owner is sentenced to imprisonment of one to eight years.
And according to the second device, it is said that each alone committed criminal work “The possession of the official person in performing official duties” by Article 409, paragraph 1 of the Criminal Code, after obstructing Kosovo Assembly deputies in carrying out official duties.
