Court decision Constitution does not recognise Dimal Basha as speaker of the Parliament

The Constitutional Court today has found that the Kosovo Assembly is not constitutionalised without the Serbian deputy chairman's election.

“BE DEATH, acceptable demand;
BE CONSTATTE, which the Assembly Convention hearing, launched on April 15th 2025, has not ended as a result of the election of the deputy head of the Parliament from the ranks of Serb community deputies, and the Parliament has not been conditioned in accordance with the definitions of Article 1 [Zedjam and Mandati] paragraph 1 and Article 4 of Article 67 [the election of the President and the Subheads] of the Constitution of the Republic of Kosovo (4)x0>, is said at one point in the Constitutional decision.
After the majority of Serbian deputies in the Assembly had been put to the polls, and none of them had received votes é a procedure that the List of Srpska had opposed even with non-participating Basha had then said “concedersedon” that the failure to elect one of the five vice-presidents could not be an obstacle to not converting the Kosovo Assembly.
All options for selecting the fifth deputy chairman coming from the non-Serb community have been exhausted. No one has been elected vice president where eight of them have not received the necessary votes for the vice president of the Parliament in all attempts, while two have refused to be candidates for deputy chairman. We as a Assembly have no other option as to how to proceed with the deputy chairman who comes from the Serb community, so in this case I consider that we have also unveiled the fourth point of the constitutional session's agenda and that since there is no other objective of how to proceed further, I consider this Constitus session considered to be closed”.
Basha had said that since the Assembly is constitutional, according to him, then she could proceed with the Assembly Headship meeting. But, at this meeting, the members of headship from other Albanian parties went to the club.
On behalf of functionalisation of the Parliament and materialisation of the February 9th election result, I consider that the election of one of the five vice-presidents, or one of the six members of the headship, cannot become an obstacle blocking the constitution of the Republic of Kosovo. After completing the Constituent session, I consider that the Assembly should continue to work as envisioned with the Constitutions, while how to proceed further with our work as the Parliament, I consider that I will consult elected members of the Parliament's Headship”, Basha had said.. /Periscopi/
