The Constitutional Court through a communiqué for the media has expressed its concern over, as “has said, the reckless declarations of senior state officials and political elected”.
The point is that the independence of the Constitutional Court is not the privilege of its judges, but is the foundation of the rule of law, follows Periscope.
The Constitutional Court's decisions are stressed and based exclusively on the Constitution of the Republic of Kosovo, its judicial practice, as well as on international standards for protecting fundamental human rights and freedoms.
Full communication:
The Constitutional Court of the Republic of Kosovo expresses its concern regarding the reckless statements of senior state officials and political elected.
Independence of the Constitutional Court is not the privilege of its judges, but is the foundation of the rule of law.
The independence and impartiality of the Constitutional Court of the Republic of Kosovo are protected by the Constitution, and no institution, political or individual parties can interfere with its work. Every attempt to exert pressure on constitutional judges is a violation of the fundamental principle of separation of powers and undermines citizens' trust in rule of law and democracy itself.
The Constitutional Court decisions are based exclusively on the Constitution of the Republic of Kosovo, on its judicial practice, as well as on international standards for the protection of fundamental human rights and freedoms. Consequently, any declaration trying to relate or prejudge the Constitutional Court's decisions is not only irresponsible but also harmful to the country's democratic development.
The court appeals to all sides to respect its independence, refrain from statements that violate the integrity of judges and their independent decision making, and contribute to strengthening constitutional order.
Only by respecting this fundamental principle can a just, democratic and functional society be guaranteed for all Kosovo citizens.
