Basha violates two-legged regulation: “The issue can go to Constitutional Court”

Researchers at the Kosovo Institute for Justice, Melos Kolshi, in a pronomination for Periscope, said there is no constitutional haven after having five vice-presidents, including those of communities.
“Based on the Constitutional Court, Court of Constitutional Court and the Framework Act, the Constituent and Parliament hearings end only after the Speaker and deputy speakers of the Parliament have been elected. Also, the rule of the Assembly clearly stipulates that the leadership consists of the mayor and five deputy speakers, including the representative of the Serb community and that of other non-most communities. So, we don't have a living place without five vice-presidents. We should be aware that the election of the Serbian community's deputy leader is constitutional guarantee and is not a privilege granted to them as a community. In that sense, the election of only four vice-presidents and the putting out of the Serbian community's deputy chairman cannot be considered a complete institution of the Parliament. Without the fulfillment of this condition, the Assembly is neither constitutionalised nor has any functional leadership, despite statements by the current chairman. Parliamentary practice shows that candidates for deputy heads of communities are proposed in writing and voted in packages, ensuring representation of all”, Kolshi told Periscope.
On the other hand, IKD researcher said the vote for deputy mayors should be voted and if this blockade continues, then the issue should be addressed by the Constitutional Court.
“The IKD calls for the new Speaker of the Parliament to repeat the voting procedure of deputy mayors from the communities and the process to be carried out in accordance with the Constitution, the Assembly Order and the Constitutional Court's recent act. If this blocking approach continues, the way is opened for the issue to be handled by the Constitutional Court, which has the authority to determine whether the Assembly is constitutional in line with its constitution and norms. Primary importance should be given to respecting the constitutional and legal spirit, not to the immediate party or individual interests, as granting priority over party interests is leading us towards delays in forming institutions and operating their”, Kolshi concluded.
The Kosovo Assembly has entered a new political stalemate after President Dimal Basha announced the “closed” Saturday's constitutional session, though it was not elected deputy chairman by the Serb community. The move was named by the Vetevendosje Movement as a step towards functionalisation of institutions, but was rejected by other parties.
