Renowned lawyer Jevdet Smakqi has reacted sharply following the third act of Kosovo Constitutional Court (r. KO265/25, which states that the Kosovo Assembly has not been constitutionalised without the Serbian community's election of deputy chairman and gives the 12-day term to the Parliament to do so, writes Periscopi.
On a proposal for Periscope, Smakqi has pressed charges against incumbent Prime Minister Albin Kurti, calling him the main responsibility for the institutional crisis going through the country.
“Sic we've highlighted, the blockade for non-compliance of the Parliament has been politically motivated, from the personal ego to the composition of an individual who was voted mostly by citizens in 09.02.2025, known as Albin Kurti,” He declared Smakqi.
He stressed that in these 18 years of independence, the Republic of Kosovo has never experienced such a political and constitutional crisis.
Kosovo has needed these three Constitutional Court judgments, as procedures have been clear in Article 66 and 67 of the Constitution of Kosovo and in Article 12, paragraph 5 of the Parliament Rule. ”- Smakqi told Periscope.
Smakqi also sharply criticised the behaviour of Parliament Speaker Dimal Basha for the way the voting procedure for vice-presidents has been derailed by non-most communities.
The winning party and its chairman, Dimal Basha, have violated the Constitution with the deviation of the practice and procedure of proposal and separate voting of the Parliament's vice-presidents from the non-party communities.”, He said it.
He warns that even though the Constitutional Court has set a 12-day deadline for choosing the Serbian deputy chairman, this decision will not be implemented and that Kurti has ominous goals to undo the Kosovo state foundation.
I am convinced that this bias will not be implemented by this miserable, perverse legislature, delivered to political anarchy. The 12-day deadline will not be respected unless a miracle occurs. Currently, the entire democratic world, the friendly states, and especially the freedom-making US-garantus, are convinced that Albin Kurti has ominous purposes to undo the foundation of the Republic of Kosovo in the name of the false nationalism as fighting the Serbian List.”- The lawyer said.
According to Smakqi, if, after completing the 12-day term, the Parliament does not fulfil its constitutional obligation, the president is expected to apply to the Constitutional and then announce the extraordinary elections, just as in the case of the government's collapse of Hoti through the issue of Ethem Arifi.
After 12 days, the president will apply to the Constitutional Court, and then the JPC will order the President to announce the extraordinary elections within a 45-day term, as in the case of Ethem Arifi.” Smakqi told Periscope
Smakqi concludes the statement with an alarming assessment of the current situation in the country.
There are deep crises waiting for Kosovo, with unpredictable consequences, without a framework, without Government.
