Democratic League of Kosovo MP Krenar Xhaferi has spoken about expectations of the Constitutional Court's decision on the draft constitution issue, stressing that the solution to the political stalemate should come through respecting the will of the parliamentary majority.
“The solution of the political stalemate we are going through and the prevention of similar crises in the future lies in respecting a fundamental democratic principle: whoever has the majority in the Assembly should have the right to form institutions”, Xhaferi told Front Online.
He stressed that this principle applies equally to the formation of both the government and the Assembly, where most should choose leadership and governing structures.
The democratic functioning of institutions and the political blockades” will be provided only that way, he said.
Commenting on the possibility that the Constitutional Court would receive the mandate of some MPs, Xhaferi said such a thing is not in its competencies.
However, he demanded that the Court assess the behaviour that, according to him, constitutes overcoming constitutional competencies on the part of Vetevendosje and the chairman of the hearings.
I don't believe the Constitutional Court has the authority to take over the mandate of MPs. But what can and must happen is for the Court to assess whether constitutional competence is beyond Mr. Dehari and Vetevendosje Movement, which for months have been blocking the functioning of the” Assembly, he said.
According to him, if such overstepping is found, the Court does not receive mandates, but it may be unable to exercise the presiding function of hearings by individuals who have violated the rules and blocked the institution.
“This would be a measure in line with the Constitution and with the need to restore the democratic functionality of the Parliament”, Xhaferi said.
Xhaferi has commented on the warned protest for the support of former KLA leaders being tried in The Hague, naming the KLA war an integral part of Kosovo's liberation history.
“I am personally not in Kosovo, but I think the KLA war has been a fair fight for the country's liberation, Xhaferi said.
He added that his contribution The KLA should be viewed in co-operation with the institutional path of peaceful resistance led by President Ibrahim Rugova.
“S, along with the peaceful resistance of President Rugova, both roads have played an important role in achieving Kosovo's independence, in its liberation and in building a democratic state, as we have targeted and as we have worked to build our country, he said.
According to the LDK deputy, it is wrong for the KLA war to be handled outside the historical context.
In this context, I think the KLA war should not be treated outside this historical framework. It cannot be cut off from the contribution it has made to the liberation process and the establishment of Kosovo's freedom, he said./Periscopi/
