Thaci addresses Special Appeal for bringing down the indictment for intervention in justice

According to his defense, the court has exceeded competencies by allowing the establishment of a new case, known as “Case 12”, in parallel to the already existing process of Thaci and former fighters in “Rastin 06”.
The defence team argues that dealing with the same facts in two different processes risks conflicting decisions and violates the former president's presumption of innocence.
The appeal was presented on 18 August 2025, and is expected to be reviewed by the tribunal in the coming days.

Thaci's defence underlines that the judge-appointed has initially exercised two different roles within the same case, as judge of the investigative phase and then as preliminary judges, which by law is not allowed.
According to the defence, the judge's refusal to examine the validity of its self-repute conflicts with the tribunal's fundamental right.
Based on these arguments, lawyer Sophie Menegon, representing Thaci, has asked Appeals Colleague “to establish that the pre-procedure judge has not had the ability to establish the indictment in case 12, and for that reason, protection requires that the indictment be cast into a total of”.
Meanwhile, to Hashim Thaci at the Special Court a total of 21 counts, divided into two cases: 10 for war crimes and 11 for obstructing justice administration.
