Democratic Party of Kosovo MP (PDK), Abelard Tahiri, has reacted sharply to a Commercial Court decision, naming it a serious act against public interest and in the service of enriching a private company. According to him, the court has wrongly decided that the Public Banking Company (NPB) would fulfil a construction contract related to a consortium of private companies, though the legal deadline for its implementation had expired and implementation had never started.

Tahiri recalls that this contract was signed during the second mandate of the Vetevendosje Movement at the helm of the Pristina municipality (2017%2021), and that the PDK had rejected and challenged it in legal ways. He stresses that the court not only did not refuse the request for compensation of material damage worth over 36m euros, but decided to force NPB to implement an agreement that it considers illegal.

Named this as another “akt institutional robbery” by the outgoing government, Tahiri has announced he has committed a team of professional lawyers led by lawyer Faton Fetah to challenge this decision in the highest judicial incidents. According to him, this team will work pro-bonds, aimed at protecting the interest of Kosovo citizens.

The Commercial Court, founded by Albulen Haxhiu and the Parliamentary Group of the Vetevendosje Movement, has decided to harm public interest by enriching a private company at the expense of the overall interest and taxpayers of the Republic of Kosovo.
The Commercial Court, after reviewing the indictment of a consortium of private companies that had contracts with the Public National Company for the joint construction of over 600,000 square metres, has illegally and unmatched to force the National Public Company to meet a contract, the legal deadline for implementation of which it had expired.
This harmful contract was linked to the second mandate of the Vetevendosje Movement in Pristina (2017-2021) and which, The PDK, not only has it failed, but we have requested its cancellation in legal ways.
Although the demand of this private consortium had as the first requirement for the fulfillment of the contract and as a second requirement for compensation of material damage and lost profits worth over 36m euros, the Kosovo Commercial Court did not even refuse the request for compensation for the damage, but forced the National Public Company to meet a contract, the implementation of which had never begun. As a result, the court's decision to establish an obligation to its fulfillment was groundless and illegal.
This is another act of institutional robbery from this government on the run, a power mired in failure and corruption, which is trying to empty the public safe until the last day of the mandate.
As a former Minister of Justice, I have taken over to organise a team of the best lawyers I've been working with for more than 10 years under attorney Faton Fetah's leadership. The work of this team will be completely pro bono with the aim of protecting public interest and stopping this robbery against Kosovo citizens.
Today, they have filed a complaint against this illegal decision in the Second Stair Chambers of this court, and the battle for justice, for the protection of public interest and the citizens of Pristina, we will follow at every step and in every judicial instance.
