The Democratic League of Kosovo has expressed its full confidence that the Constitutional Court will act in line with its constitutional mandate and issue a fair decision regarding the current situation of the institutional blockade.
In a statement to the press, the LDK says the material handed down by the party, before the Constitutional Court, has essentially an inexplicable fact: the political subject that appeared first in the election has not implemented the constitutional session agenda, refusing to propose a candidate for Parliament Speaker.
“Instead, through repeated insistence ʹ totaling 48 times ] has called for voting outside the agenda and outside the constitutional procedure, rather than proposing the candidate for the Parliamentary Speaker as required by the Constitution and parliamentary practice.
This behavior has produced deliberate blockades and proved that the subject in question has had neither the will nor the capacity to exercise the right and responsibility belonging to the first” is said in the statement.
The LDK says it has made it clear that, in line with previous Constitutional Court decisions and with the fundamental principles of functioning of the parliamentary constitutional system, if the first subject fails to secure a majority, the right to propose the candidate must meet with parliamentary majority. The democratic system functions on the basis of majority and responsibility, not the blockade and lack of political will.
The Constitutional Court has a key role in ensuring the functioning of institutions and in protecting democratic order in full compliance with the Kosovo Constitution.
The LDK expects from the Constitutional Court a fair decision and, in line with the spirit of the Constitution, paves the way for parliamentary majority to exercise the right to propose the candidate for Speaker of the Parliament and restore institutional normal” is said further in the party statement.. /Periscopi/
