Krasniqi has said that Dimal Basha enjoys no competence to exercise full functions until the constitutional sessions are completed.
The election of the Speaker and five vice-presidents of the Parliament is seen in the same sub-the Constitution (neen 67.1). These two acts cannot be shared, since only with the choice of the mayor and the five vice-presidents, the Parliament is considered constitutionalised”, has explained Krasniqi.
According to him, the newly elected Speaker of the Assembly enjoys no full competence to exercise his functions until the constitutional session is completed. Until then, his role is merely technical: to conduct the constitutional session, not to exercise other functions. Even the previous ruling of the Parliament did not even recognize the possibility that the elected chairman would take over the session without even being elected the vice president; at that time, the constitutional session was led to the end by the oldest MP.
In this sense, the call of the Assembly of the Headship of the Parliament without being elected by all five vice-presidents and without the constitutional Assembly is illegal. Any such decision is violated in legitimacy, and none of the three legally elected vice-presidents should participate in this meeting”, analyst Krasniqi has said.
The Assembly Constitution Process must be restored where it remains: to elect two vice-presidents from the non-communal ranks. Only after completing this step can the Assembly be considered constitutionalised and its legitimate headship to exercise the function envisioned with the Constitutions and Order”, he noted.
