Top Kolshi in 2024 was sentenced to 800 euros for allegedly hitting Enver Bayraktari with plastic tubes

The “Justice Vow” has secured the Constitutional Court's decision in Pristina, the Lipjan branch, taken on October 8, 2024, in which Kolshi was reportedly convicted and sentenced to six months in prison, which was replaced with 800 euros in fine, on the consent of the accused, broadcasts Periscope.

According to the decision, on August 25, 2022 in the village of Bajica, the Lipjan municipality, following a preliminary dispute between Top Kolshi and now victim Enver Bajraktari, Kolshi strikes with plastic pipes on his head and various body parts. The decision says that Kolshi had then beaten Bajraktari even with a slap, causing him to fry and swell. “ ... damaged as a result of the shocks has suffered frying and mildness, bleeding under the skin on the arm, 3 hematoma on the back, 5 hematoma in the butt, 3 hematoma on the left leg, 2 hematoma on the head, and redness and scratching of the right ear, injuries caused by the strong assault on the king, which as such as DHEMIT EARTH TRUE with temporary health consequences”, the decision says.

With these actions, according to the indictment, Top Kolshi has committed the criminal work “light bodily access” by Article 185, paragraph 2 concerning paragraph 1, posts 1.4 of the Kosovo Criminal Code. According to the decision, Kolshi had always pleaded guilty, had expressed regret, and had promised the Court that he would not repeat those actions. He said he'd fucked up with the late Bajraktari now.

“In the initial review, the defendant has stated that he feels guilty and admits guilt with his will, without pressure, with full consciousness. He has expressed regret, regret that he is in court, after two days he has declared that he has agreed with Enver and his family.

The judge has promised him that he doesn't repeat it with this criminal act and he hasn't repeated it and he's working on farming for families and for himself. He has promised the court that this will not happen again”, it says in that decision. The ruling is said to have hired Kolshi's lawyer, Halim Shala, praying to the court that, in case of criminal sanctions, the accused's economic situation, reconciliation with the damaged party and the promise that in the future will not repeat such acts that conflict with the law.

State prosecutor Nebahate Salihu, on the other hand, had not rejected the guilty plea, proposing that Koles be found guilty and given due sentence, and has proposed that, in the case of measuring the sentence as an easy-to-take plea, while as a serious circumstance, the high degree of willingness to commit criminal work. Later, the Court had approved the guilty pleas made by Kolshi, condemning him to six months in prison, which, with the consent of the accused himself, had been replaced by 800 euros in fines. It mentions that the Court, in the case of the verdict, took into account the fact that the accused had been convicted before.

Less than a year after that sentence, Top Kolshi allegedly killed and buried the person accused of causing bodily injury, Enver Bajraktar, killing and burying him in Bayca Lipjan between August 3rd and 4th 2025.
