KDI: Blockada in Parliament has seriously violated institutional functioning and constitutional order

During the media conference, Eugen Cakoli from KDI stressed that the non-compliance of the Parliament has created an institutional vacuum, where citizens are left without political representation, the government in the resignation acts without parliamentary supervision, and independent institutions have remained out of democratic control.

“The Assembly is not just a legislative institution. It is the foundation of Kosovo's constitutional order. Without a functional framework, citizens have been excluded from decision-making and the state has entered a stage of pause”, Cakoli said.

According to KDI analysis, the lack of the Assembly has affected some plains of state functioning. First of all, the 30-day constitutional deadline for its institution has not been respected, as the Constitutional Court determined in the KO124/25 ruling. This disregard constitutes clear violations of the constitutional order and undermines the principle that the court's decisions are final and binding. Above all, this has put the country on an unmarked constitutional ground, with unpredictable consequences, which would have to be clarified by the Constitutional Court.

In this period of the vacuum, the government in the resignation has made decisions of great political and financial influence ? including over 70m euros of budgetary commitments in lack of parliamentary control and outside the limited mandate the Law defines for Government.

“Decisions to split subsidies, foundation of permanent commissions, or cadrovic changes on public boards have been taken, without any supervisory filter or institutional discussion”, was said away.

According to this analysis, key reforms warned and agreed on, such as Vettingu and the Civil Code, have been put on hold.

“5 laws of justice reform are blocked. Also, the process of ratification of international agreements has been completely interrupted, including those linked to the International Monetary Fund, the World Bank and the European Union's Growth Plan, which is expected to bring over 800m euros to Kosovo. Without a functional framework, all these partnerships are exposed to failure, since each one of them must proceed to parliamentary procedure from zero points ) a process that averages 3 to 6 months”, the report said.

According to KDI, the situation is not limited in terms of lawmakers.

“Mbi 20 independent institutions, with an annual budget of 59m euros, have remained without supervision. Their reports for 2024 have not been reviewed, while some boards continue to remain dysfunctional. This paves the way for political interference, lack of transparency and misuse of public funds.

The other aspect of the impact of the institutional blockade is the exclusion of citizens from democratic representation. For nearly a year, and especially for three months, Kosovo has functioned effectively without the Parliament without representation, without control and voice of citizens within institutions. This situation undermines institutional legitimacy and irreversibly damages public confidence in the democratic system”, KDI said further.

At the conclusion of the conference, KDI called on all political institutions and actsers to act without delay and in line with principles of compromise and political consensus, as defined by the Constitutional Court. Also, a thorough audit of the Government's decision-making in resignation was required during the blockade period. /Telegraphy/
