Acting Justice Minister Albulen Haxhiu, at a news conference, has stated that the Constitution does not allow an MP to be subject to the assessment by the Constitutional Court.
According to her, the Constitutional Court can only make assessments to the president of the country and handle the acts of the Republic of Kosovo Assembly, but not specific cases related to an individual, as in this case the chairman of the constitutional hearing.
Haxhiu has stressed that the final decision by the Court, for the election process of the Parliament's president to be made by an open vote, and that a candidate could be voted only three times, conflicts with its pre-breaking directive, where it was said the Constitution does not determine whether the vote for the Parliament's chairman should be open or secret, placing this decision on the will of MPs.
The question is: where does the Constitutional Court get this right? Only MPs have the authority to decide whether the vote will be open or secret. The constitution doesn't predict that. In this case, the Court has robbed the constitutional competencies of the Kosovo Assembly”, she said./Periscopi/
