Former Kosovo Constitutional Court Judge Kadri Kryeziu has split his stance regarding the decision the Constitution is expected to take on August 8th over the situation created following the Kosovo Assembly's failure.
Through a reaction to social networking, Kryeziu has presented three possible scenarios, stressing that these are only personal thoughts and that the real value belongs only to the decision of the current court composition.
The first scenario, which he claims is the most rational and the most likely, suggests that the Court recognizes the President of the Republic's right to declare extraordinary elections. Kryeziu argues that the non-compliance of the Assembly is hindering the formation of the Government and the functioning of political power, which represents an institutional crisis justifying this step.
The second scenario, which he calls the least desirable, is the one where the Court decides to “respect” the 30-day term for the constitutionalisation of the Parliament, returning responsibility again to the current legislature. Kryeziu says such a decision could harm the Constitutional seriousness.
The third scenario, which calls it the worst, is one where the right to nomination the Speaker of the Parliament is passed from one parliamentary group to another. According to Kryeziu, this would constitute changing game rules during the process and would be legally unacceptable.
Speaking of the current composition of the Constitution, Kryeziu expressed with appreciation the judges' professionalism and intellectual courage, saying he believes their decision will lead the country out of judicial uncertainty.
In the end, he spared no criticism of former Constitutional Court head Enver Hasani, considering him responsible for the current situation and expressing regret for his earlier silence that, according to him, helped realise the dark “ <x1 plan.
Kryeziu said that despite the decision the Constitution will make, this legislature has already lost credibility and that elections are the only way to restore citizens' confidence./Periscopi/
