Explaining
In response to media interest and broad opinion in terms of the President of the Republic of Kosovo's request of August 5th 2025 for the withdrawal of the KO215/25 demand, submitted to the Constitutional Court of the Republic of Kosovo on July 22nd 2025, the Constitutional Court explains the following:
Based on Article 113 [Juridication and Authorised Pals] of the Constitution of the Republic of Kosovo, the Constitutional Court deals with all cases handed over legally by authorised parties. The division of subjects for examination by reporting judges and college reviews at the Constitutional Court is done on the basis of clear procedural rules, which this Court respects exactly. The Constitutional Court, as a college organ, makes its decisions complete. In this context, it is the right of the parties before the Court to seek the withdrawal of the set requirements, which the Constitutional Court deals with based on the Constitutional Court, the Constitutional Court Law, and its work regulation.
As related to cases raised with Constitutional Court Judge Radomir Laban, as you are informed, the same has been employed at the Constitutional Court since 2011, in the position of the Judicial Council, and since 9 August 2018, exercises the post of Constitutional Court Judge, having submitted to all constitutional and legal procedures, for his proposal from the Parliament of the Republic of Kosovo and the decree by the president of the Republic of Kosovo. On the other hand, procedures for the dismissal of judges are clearly defined in the Constitution.
The Constitutional Court as the final authority in the Republic of Kosovo for interpretation of the Constitution, in accordance with its responsibilities and mandate, addresses all requirements granted by parties authorised with impartiality, dedication and professionalism, as defined in the Constitution of the Republic of Kosovo.
