“High command responsibility” A special prosecutor publishes 21 Serbs' initials for expulsion of Albanians during the war

According to the indictment, during this period, defendants have been aware that forces under their command were carrying out actions that were carried out through a broad and co-ordinated campaign involving: the destruction of property, the burning of houses, persecution and arbitrary bans of persons on ethnic grounds, armed attacks on villages and cities inhabited by Albanian civilian populations, with the intent of violently shifting within the territory of the then Kosovo administrative borders.

Pristina, August 15th 2025 The Special Prosecutor of the Republic of Kosovo has handed over to the Constitutional Court in Pristina -- an indictment in absentia against 21 persons for criminal work “Crime Against Civil People”.
21 defendants Mr. P, M. C, R. M, D.A., O.S., R, G.R., B.J., S.I., B.V., S. P, N. P, KJ, L.S., B.D., R.S, D.Z., M.G., L. C, B. The F, M.K., is charged that, in the quality of those with command responsibility, during the January period of June 1999, they have been involved in the violent expulsion of the Albanian civilian population from Kosovo territory.
According to the indictment, during this period, defendants have been aware that forces under their command were carrying out actions that were carried out through a broad and co-ordinated campaign involving: the destruction of property, the burning of houses, persecution and arbitrary detention of persons on ethnic grounds, armed attacks on villages and cities inhabited by Albanian civilian populations, with the intent of violently shifting within the territory of the then Kosovo administrative borders.
The investigation leaves a well-founded doubt that as a result of these actions, about 862,979 Albanian civilians have been forcibly expelled from their homes towards borders with Albania and the former Yugoslav Republic of Macedonia.
The 21 defendants are charged with failing to take necessary measures that were in their competence and responsibility to prevent such actions, prevent or punish authors or report illegal acts to the respective authorities.
In support of Article 234 and 303 of the Code of Criminal Procedure, the Special Prosecutor, has proposed to the Constitutional Court in Pristina to hold trial in absentia because defendants are unable to obtain justice organs.
The Special Prosecutor remains committed to prosecuting crimes committed during the war in Kosovo, ensuring justice for the victims and putting the leaders of these acts accountable, in line with international standards.
