According to Osmani, the second degree of the Commercial Court has canceled only the 4th point of act-first decision, which suspends the extraction of businesses into the open energy market. Osmani has warned that businesses will continue the legal battle with the ERE until the Constitutional Court.
“actually the second degree decision we have yesterday is just about the 4th point of act on the first degree act which has determined the suspension measure is not the decision that has dropped to the whole of the first degree, but just one of the points of the bias that has only to deal with the pending mass. So it's only about the suspending measure that has set the first scale, while for the rest of the points of the act is still under way. That means that until we have agreed to the second degree decision, there is no suspension measure for free market, and the liberalisation process continues until we have a firm form decision. ”
The Commercial Court ruled in favour of the ZERE by canceling the fourth point of the first Act of Justice, which suspended the process of the open energy market. After this decision Z The RRE has the right to proceed with the process of free energy market.
Meanwhile, lawyer Osmani has warned that businesses will continue their legal battle until the Constitutional Court.
“As far as the decision on the pending measure is concerned, we will take the other legal actions that we have available, we will also address the Constitutional Court. While in terms of the other part of the act, we are awaiting the second degree decision which will also review the ZERE complaint and our answers to the ZERE complaint and after the second degree decision we will see the legal means at hand.
