Alliance of Businesses for Contemporary Second Scale Decision: Anke to Constitutional Court

Kosovo's Commercial Court, Second Scale, has ruled in favour of the Energy Regulatory Office ( ZRGE) about the decision to transition about 1,000 local production businesses to the open electricity market. With this decision, which has taken a firm form at this stage, the request [...] is denied
This development has prompted reactions in the business community, especially from the Kosovar Business Alliance (AKB), which had earlier deemed the First Stairway decision to annul ZRE's move. UN Chairman Agim Sahini told Periscope that although judicial decisions should be respected, Z. The RRE should have considered the right of businesses to follow complaining procedures.
He stressed that the Alliance will address the Supreme Court with complaints, and until its review, the decision should not be implemented. “in democracy should be taught that whether decisions are favourable or disparatory to the parties, they should be respected”, Sahin said.
He appealed that businesses continue their activity and follow legal procedures, stressing that the Constitution of Kosovo guarantees the right to defence in court. However, Sahin warned that the situation created by the high power price is putting local businesses in a difficult position and is making Kosovo one of the most expensive places for foreign investors.
“Businesses have always been hit, remain hit, vulnerable, and Kosovo is becoming one of the most expensive places for foreign investors. No one will come to us to invest and develop the country. In spite of that, most of the businesses already affected by this costly shock will leave Kosovo and find a market outside Kosovo”, he said.
Asked whether there would be meetings with MPs or with the ombudsman, Sahin confirmed that all legal means for protecting business interests would be exploited. “Of course we will seek all our right to defend, whether it be to the ombudsman, political parties or MPs who enjoy the right to prosecute this complaint at the Constitutional Court”, he said.
At the heart of the debate lies the ZER's decision that all businesses with over 50 workers or circulation over 10m euros a year pass into the open electricity supply market, which is being rejected by the business community with the argument that there are still not enough and serious operators in Kosovo for sustainable and competitive energy supplies.
RER wins against businesses: Decision to delay implementation of “Free Trade”
Periscope During the Friday day, he had reported that more than a week has taken place since the Commercial Court had suspended the decision of the Energy Regulatory Office (ZRRE), which concerns the emergence of businesses on the liberalised electricity market. At the Court's announcement, it was said that Mr. The RRE to bring all consumers into the free market, based on a false interpretation of legal provisions, is a serious violation of the law. /Periscope
