Pristina, 16 July 2025 Kosovo Supreme Court expresses regret for the government's biased response to its judgment; P.A.n. 092025, through which Administrator Guides (MFPT) no.012025 for utilisation of Fiscal Electronic Equipment, Fiscal Systems and Fiscal software.
The government's reaction in office constitutes, not only a misinterpretation of the nature of judicial decision-making, but also an unacceptable intervention in judicial independence. All institutions, including Government, are obliged to respect the independence of the judiciary as one of the foundations of the constitutional order of the Republic of Kosovo.
The Supreme Court's decisions are based on the Constitutions and on the ruling laws of the Republic of Kosovo, and as such should be respected.
The Supreme Court as law enforcement, both in concrete cases, has guaranteed that the sublegal act is in line with the judicial standards regulating the way and time of their adoption. Therefore, any attempt to question the authority of the Court and the legitimacy of its decisions, through political statements, violates the independence of the judiciary and undermines citizens' trust in the institutions of justice.
The Supreme Court expects the state institutions to show readiness to implement judicial decisions as a condition of the rule of law.
The Supreme Court will continue to exercise its office independently and undirected, guaranteeing law enforcement.
