The special accepted Serbian MUPCH material as evidence, Haxhiu: Unacceptable, stripped court of constitutional legitimacy

Albulen Haxhiu, acting Justice Minister, has reacted after the Special has accepted as evidence some documents submitted by Serbia's state institutions, including the Ministry of Internal Affairs. Haxhiu has said that this has been taken with concern and that this development is deeply unacceptable. Minister in charge [...]
The incumbent Justice Minister has also said that these Serbian institutions are of a regime that was responsible for systematic violence, war crimes, forced disappearance, genocide, ethnic cleansing and brutal pressure on the people of Kosovo.
With concern we have received news that the Specialised Chambers in The Hague have accepted as material evidence documents handed down by Serbia's state institutions, including the State Security Department, the Ministry of Internal Affairs and the so-called “Commander for Kosovo and Metohija”. This development is deeply unacceptable. Institutions in question are structures of a regime that has been responsible for systematic violence, war crimes, forced extinction, genocide, ethnic cleansing and brutal pressure on the people of Kosovo. Accepting materials produced by this regime as reliable sources constitutes a serious deformity of justice and an open insult to war victims and the sacrifice for freedom, it has written.
On the other hand, she has criticised the tribunal for a statement by calling the same as the wrong and unjust Juridically.
The tryst of the Court, with a sentence like “Furthermore, the fact that certain proposed evidence comes from Serbian authorities does not, in itself, constitute a stop for their accession. ” (front. 17), besides being legally wrong and unfair, she wrote.
She has mentioned one of the criteria for assessing the availability of evidence, which is that if their source has an interest in the outcome of the process in question.
) This shocking claim is contrary to established practices of international criminal justice, under which one of the most important criteria for assessing the authenticity of evidence is whether their source has an interest in the outcome of the process or other indicator of bias. The Court's refusal to take this criterion into account raises serious doubts about the impartiality of the court judges themselves, it has written.
Haxhiu has estimated that accepting these documents is unacceptable and wrong, and that he cannot trust documents produced by a state criminal money.
The use of documents produced by Serbian regime institutions is wrong and unacceptable. There can be no trust in documents that were produced by a state criminal device, not to build justice, but to manipulate the truth, blame the victim and house the criminal, she has followed.
In the end, incumbent Justice Minister, acceptance of documents produced by the Milosevic regime, which has been tried by The Hague International Court, stripped the Special of constitutional legitimacy and turned it into an instrument of the old logic of denying the truth.
Slobodan Milosevic and his associates have been tried at The Hague International war crimes tribunal. Accepting documents produced by their regime by a court acting on behalf of the Republic of Kosovo stripped this court of constitutional legitimacy and turned it into an instrument of the old logic of denying truth, equalising the parties and relating crimes. This is not only unfair, but politically unacceptable; it is over.
