Lawyers of the accused at The Hague have voiced criticism at several judges, for whom they have stressed that they have shown partiality in the process by asking orient questions to witnesses. Meanwhile, a judge has enjoyed a post in LinkedIn, referring to a meeting between representatives of France and those of Serbia.
But in a written interview given the Time, Trendafilova stressed that there have been no disciplinary procedures to any judge so far.
She has talked about the recent visit to Kosovo, the court processes that are under way in The Hague, and even the witnesses.
“People have the right to protest of course, but personally it doesn't seem to make sense to prevent journalists from asking questions. Some people seem to fear objective and transparent information. I know that the court's mandate does not enjoy popularity with some in Kosovo. But it is a fact that the Specialised Chambers were created through the amendment of the Constitution of Kosovo and as a result of an agreement between the EU and Kosovo. Therefore, the court is acting in accordance with the mandate it has been given. This mandate includes, as in any system based on rule of law, fair, independent and impartial judgment, protection of the defendants' human rights”.
As in the past years, I came to Kosovo to explain the cases to people and to clarify any questions or confusion. This, because I consider it important that Special Chambers communicate about judgments as transparent as possible. Judicial processes are important for Kosovo, and for this reason all need to understand that the court's mandate is to develop fair, independent, impartial and secure procedures, as well as how this works in practice. But some people, for whatever reason, do not want such information to be communicated to the public through critical questions from journalists.
