The incumbent Prime Minister, Albin Kurti, and his ministers, who have also been certified as deputies after the February 9th elections, are standing illegally in executive positions. So has International Law Professor and former Constitutional Court Chairman Enver Hasani, for Kosovapress.
According to Hasani, this situation is clear and confirmed by the Supreme Court's act of justice, which it calls professional and mandatory for implementation, as it cannot be complained to the Constitutional Court by a government in office.
The Supreme Court, on 15 July, ruled that the extraction of sublaw acts by ministers who are currently MPs is contrary to the Constitution, stressing that such a thing constitutes violations of constitutional provisions.
Hasan stresses that any disrespect of this decision could constitute criminal acts on the part of ministers in office who have already been certified as MPs.
“The Supreme has not interpreted the Constitution, but it has only implemented it, as the Constitution forces it,” ) Hasani has said.
On the other hand, the incumbent government has rejected the Supreme decision, viewing it as unilateral and arbitrary. They have also warned of sending this act to the Constitutional Court.
However, Professor Hasani stresses that such an act is not possible on the part of the executive in office.
According to him, the Supreme One's decision is final and must be applied without exception.
He has expressed his concern whether the ministers in office will respect the Supreme Court's decision, but warns that any failure to comply with it could bring criminal consequences. According to Hasani, in this case the prosecution must act with vigilance. /Periscope/
