Three Obilic Community Officials Released From Charge

In this case, Merita Simnica as chief of the Directorate for Urban Planning, Property, Geodezee and Cadastre in the Obilic municipality, Burim Grguri as leader of the Obilic Municipal Assembly, and Ibrahim Krasniqi as construction inspector in this municipality were accused of misusing the official position or authority, reports “Betim for Justice<1>.
The trial against the three indictees was announced Thursday by Judge Allta Murseli.
Judge Murseli said the accusers are acquitted of misusing office or official authority, as they have not been proven to have committed the criminal work they were charged with.
The costs of the criminal procedure fall to the budgetary means of this court. In the meantime, to harm Obiqili's municipality, the judge announced that she did not submit a wealth-of-juridical request.
Judge Mursel announced that the parties will accept the judgment on time.
Against this act, the parties have the right to file a complaint with the Court of Appeals within the 30-day deadline after the indictment's admission.
Otherwise, with the same indictment for this criminal act (the misuse of official office) was Arben Berisha, head of the Directorate for Urban Planning, Property, Geodezi and Cadastre in the Obilic municipality.
The same one after admitting guilt at the initial session of February 15, 2021, the Constitutional Court in Pristina had sentenced him to 3 thousand and 600 euros in fines.
Otherwise, Pristina Constitutional Prosecutor Merrishe Llugqi, on September 30th 2020, had filed charges against Arben Berisha, Merita Simnica, Burim Grgurit and Ibrahim Krasniqi. All four of these accused by the prosecution were charged with criminal work “Use of official position or authority”.
According to the indictment, Arben Berisha as director of the Directorate for Urban Planning, Property, Geodezee and Cadastre in the Obilic municipality and Merita Simnica- chief in this director, in order to bring any property to himself or to the other, in this case Blerim Krasniqi- owner of the mobile factory “Berto<1> had misuseded their official positions.
According to the prosecution, the accused had done so after they issued construction permits on April 3, 2019 for the construction of the subx0>Berto” furniture factory, contrary to administrative instruction No.41/2006 and the Law on Farm Land. According to the indictment, the accused have been aware that the Ministry of Agriculture, Forestry and Rural Development had rejected Blerim Krasniqi's request for changing the land's destination into words from agriculture to inhuman.
While the head of Obilic's Municipal Assembly, Burim Grguri, was charged with having been aware of the Ministry of Agriculture's superior decision on December 26th 2018 had signed a decision with which Blerim Krasniqi's request was approved for changing land from agricultural to inhospitable, which, according to the Prosecutor's Law on Agricultural Land, administrative guidelines, No.41/2006, and against the 2009 Municipal and Urban Development Plan 2009-2020 of Obilic.
Ibrahim Krasniqi, on the other hand, was charged that in the quality of the construction inspector in the Obilic municipality, he misused his official position during 2017 and 2018, so that he did not take appropriate measures in accordance with his legal authorisations to cut off business construction work without permission “SB Construction”, “beni-1” and “Berto”.
According to the indictment, Krasniqi had not banned the work of three items of higher business, so he enabled the same people to complete the work without being equipped with construction permits. /Periscopi/
