The trial of the preliminary procedure has approved the Special Prosecutor's request of the Republic of Kosovo for the appointment of the detention measure against the B.J. indictees, so that the same is appointed as the 1 (one) month” detention measure, the court said.
After holding the hearing hearing, the court estimated that the appointment of the detention measure to this criminal case is adequate because if the defendant is released in freedom, “has the risk of running away, it could avoid criminal procedure and that the same would be elusive for justice organs, as the same suspect is suspected of criminal acts of highly high risk, as well as taking on the basis that the same violates national security, the lives of officials and the citizens of the Republic of Kosovo (4)>
The court also estimated that if the defendant is released, the same could affect evidence and witnesses, as well as repeat the same criminal work or can perform other criminal acts again under the same or more severe circumstances.
“The court considers that the burden of the criminal act is of grave nature, so assigning the detention measure is a necessary measure in this criminal case and that any other measure would be insufficient for successful implementation of criminal procedure, preventing the normal course of this criminal procedure, and preventing the repetition of criminal acts<1>.
Against this act, disgruntled parties have the right to complaint at the Court of Appeals, through the Constitutional Court in Pristina.
