The whole morning the D.A. has assigned us conditions that he has never implemented on his own as regards Rule 107. So I don't understand this setting of conditions from them. I told them once again that if we need you to help us, we'll make the application before August 18,”, Misethic said.
It had more to do with the statements by prosecutor Matt Halling regarding judges' questions to protect witnesses under the 107th Rule, for which authorisation is required.
Prosecutor Halling said that in view of the statements, there is little information about the aspects of the 107th rule but that the court can do so.
“We strongly propose that the court receive ex-participation from defence teams what restrictions are and what they propose”, Halling said.
Misethic said he would do his best to call these witnesses with the reasoning that they have valid evidence. He said if their plan doesn't work, they're going to appeal to the court to bring these witnesses to testify.
Hashim Thaci's defence and Jakup Krasniqi's have announced that as part of presenting their evidence, they aim to call 17 witnesses. 12 will be Thaci's defence, while five of Krasniqi's defences.
The next sessions will be held after the summer break, which is set forth to hold the preparation conference for presenting defence evidence.
Defense: ZPS wasn't treated like we were for testing, we're able to begin on August 25th.
In Kosovo Specialised Chambers ( In The Hague, former President Hashim Thaci's defence and Jakup Krasniqi's have said they will not be able to present their evidence on August 25th 2025 as set out, as they need more time. The defence claimed that in the case of presenting evidence, they were not treated the same as the Specialised Prosecutor's Office (ZPS).

At the progress conference on Tuesday, Thaci's lawyer, Luka Misetic, first spoke of the weekly conference held in January of this year, in which defence teams had jointly demanded ten weeks of term from the decision to motion under the 130th Rule to prepare for their case. Even so, according to Misethic, this ten-week stand was not counting on the summer break.
Misetic said that even at the next conference, which was held in February 2025, Wessel's protection, represented by Rodney Dixson, had asked the court to inform whether the deadlines proposed by them were appropriate for presenting their evidence. He said that the court had said that these terms were generally acceptable.
Misethic said that in the following days, the court has given no announcement, but has changed its position, setting deadlines for preventing protection evidence -- such as offering the list of witnesses and material evidence on July 21st 2025, and setting the date for the conference to prepare defence for the rest of the trial.
The SPS had called for a change in deadlines, but defence had rejected it. Misetic said the defence opposition had collapsed in addition to the date for the defence preparation conference.
Misetic added that under this order, Thaci, as the first indictee in the indictment, has been ordered to be ready to submit his evidence from August 25th 2025. So, according to the lawyer, the defence issue, which was scheduled to begin on October 15th, begins on August 25th 2025.
The entire event was done without any kind of announcement from February until June, not taking into account the difficulties the defence has to meet the relevant” deadlines, Misethic said.
Misethic said the court has reduced the time for preparing protection from ten to two weeks.
This has created a lot of added burdens and difficulties for my team, which has worked and continues to work, beats 12 hours a day in such a way as to try to respect the appropriate deadlines. We are not aware whether the court or the judge of the preliminary procedure has handled Z. The SP in such a way that it has set deadlines to extract documents or to start SPS evidence, give the SPS the opportunity to be heard”, Misethic said.
He said these deadlines set for them have caused many difficulties in preparing defence teams.
“These are deadlines that have caused many difficulties in preparing defence teams, and as we have discussed earlier we want the opportunity to explain why our right to have the appropriate” timelines has not been passed, Misethic said.
Jakup Krasniqi's defence, represented by Aiden Ellis, joined the threats.
Prosecutor Matt Halling said discussions on the requirements for the defence to prepare its case for ten weeks must be exceeded.
While, Judge Guénawel Mettraux told the defence that at the October 1st 2024 session, they have said they need four to six weeks to prepare for their evidence.
Mettraux said the time for preparing the defence issue is set forth to be ten days in line with the 130th Rule following the verdict on the application under this rule. He said that at the request of protection, this period of time was extended, giving them six times as much time as is envisioned in regulations.
At the present session are in Hashim Thaci hall, Kadri Veselini, Rexhep Selimi. While Jakup Krasniqi is present through the video connection, including a Veselin and Krasniqi lawyer.
Meanwhile, on April 15th 2025, the prosecution has announced that it has completed presenting evidence in the case.
While, the defence had applied according to the 130th Rule, which envisions a request to drop any charges or charges in all in the indictment. The decision on this requirement was made on 16 July 2025. According to the chairman of the panel, Charles Smith III, what he had sought protection was his failure to rely on war crimes claims involving incidents that occurred before May 1998 and after June 20, 1999.

As a result, this motion had been dropped with the reasoning that the court's authority is to bring down material that constitutes accusations involving time causes.

In addition to testifying on July 16, 2025, the testimony of these two witnesses continued on July 17th 2025, ending the testimony of the victims' defence witnesses.
The Specialised Prosecutor's Office, on September 30th 2022, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, which consists of ten points on charges, where the latter are charged with war crimes and crimes against humanity.
On April 29th 2022, the Specialised Prosecutor's Office had handed over a amended indictment to Hashim Thaci, Kadri Wessel, Rexhepi and Jakup Krasniqi, where four indictees have committed war crimes even in Gjilan, Budakov and Semtish.
On November 9th 2020, in their first appearances, Hashim Thaci's Jakup Krasniqi has been declared innocent of the charges placed on them. Wessel has also been declared in his presentation on November 10th, as has Rexhep Selimi on November 11th.
