The Kosovo Democratic Institute has said President Osmani's recent request to the Constitutional Constitution raises several dilemmas.
“However, the President's request for interpretation by the Constitutional Court, presented only a few days before the 30-day deadline ends, raises several dilemmas. Initially, it is unclear where the claim for “conflicts with competencies” between the Presidency, the Parliament and Government at this moment, while the deadline is not yet over, and the Parliament still has room to fulfill its obligation to the constitution. In this sense, the demand seems to prejudge the outcome of the remaining days and weaken expectations that MPs fulfill their responsibility. After all, the question “what happens after 30 days? ” is an issue that could and should have been clarified immediately after declaring the sentence in order to ensure clarity on the legal consequences of the Parliament's non-compliance. ”
As for the suspension request, she said it was unreasonable.
“On the other hand, the requirement for suspending the constitutional deadline, in the form of a temporary measure, seems unreasonable, since the same allows “comodity” for non-action of parliamentary subjects and MPs. ”
“KDI considers the 26 June act of judgment clear and has set a 30-day term as binding and substitute for parliamentary subjects, respectively. In fact, disrespecting the deadline is a failure to fulfill a fundamental constitutional obligation. Respecting constitutional provisions and deadlines is one of the fundamental pillars of democratic order, as they aim to prevent institutional blockades and direct the acters towards solutions. Therefore, we invite parliamentary subjects to show responsibility, respect the Constitution and take the necessary action to fulfill their obligations within the deadline. Meanwhile, the Constitutional Court may clarify the consequences of the deadline deadlines, but cannot serve as a mechanism to suspend political responsibility. ”
