Volnet Bugakku from the Kosovo Democratic Institute has said the mandate of MPs will be questioned if they do not respect the deadline for the constitution. MPs have until July 26th to constitutionalise the Assembly, under the judgment the Constitutional Court has imposed.
“These 120 MPs if they fail to fulfill the constitutional act of authorisation for 30 days do not meet the legitimate mandate for what they have been elected. The mandates of these MPs after July 26th are questioned”, he said in “interactive”.
Bulaq has said further that the Constitutional Court could issue a temporary measure suspending the set deadline and that there would be no more sessions every 48 hours like the president has requested. However, according to him, the president's request to the Constitutional Constitution can take much time.
The “may have temporary measures and the measure suspends the overall effect of the deadline and conditioning until the Court decides, there will be neither sessions. Moreover, it is not determined when the Constitutional Court issues the case. For a situation where the president demands interpretation of the conflict of competence, there is no deadline for the court to issue a verdict. This could potentially take time, at least 60 days or longer. This requirement serves parties to feel comfortable and take a little time”, it has been potentiald.
The Kosovo Democratic Institute on Wednesday has estimated that the president's request for interpretation by the Constitutional Court, presented just days before the end of the 30-day term for the constitution, raises several dilemmas. KDI has stressed that specifically the question posed in the request that “what happens after 30 days” is a question that has been able to clarify immediately after declaring the sentence in order to ensure clarity on the legal consequences of the monstrous.
It is unclear, in effect, where the claim for conflict of competencies lies between the Presidency, the Parliament and Government at this moment, while the deadline is not yet over, and the Parliament still has room to fulfill its obligation to be binding. In this sense, the demand appears to prejudge the outcome of the remaining days and weaken expectations for MPs to fulfill their responsibility”, the Institute's communiqué says.
