Bajrami: The specialist has violated the Constitution and international law

Bajrami named this tribunal the “thanks to a false and fabricated report by Dick Marty”, which he said was sponsored by Russia and Serbia.
He said that through this process, it is trying to rewrite Kosovo's modern history and unfairly incriminate liberation war.
The Special Court is a politically designed project to distort the historical truth of our liberation war. It is built on an ordiner fraud of the Marty Report, and for that the silence of the Council of Europe is the pure co-existence”, Bajrami stressed.
He sharply criticised Kosovo's own institutions, viewing them as failing to defend the liberation war and the citizens facing this judicial process.
“The Assembly formed the Special Court with confidence for justice, but it has now become a monoethnic and discriminated against court, which co-operates more with Serbia than with Kosovo authorities”, he said.
Bajrami listed a series of violations that, according to him, make this court illegal and biased: long and unjustified detention, denial of the parties' equality in the process, fabricated evidence and conveyed by Serbian secret services, as well as a total lack of transparency and international monitoring.
Regarding the indictment for “joint criminal enterprise”, Bajrami said it is legally unstable and politically dangerous.
“U n CK wasn't a state army with central command. It was a popular movement, a patriotic guerrilla who had neither a state structure nor a joint criminal plan. Serbia's only state plan was to exterminate Albanians, through the genocide operation Patkoi”, the academic stressed.
He strongly criticised Kosovo institutions for failing to support the accused and in internationalising the violations that are taking place in the process.
