This institution reportedly exceeded the legal deadlines for 15 positions with a task officer, reports the presidency's financial mirrors for 2017. These positions, according to the National Audition Office, were not fulfilled in accordance with the Law on Public Officials, which envisions a regular position of work that can be maintained by task guides only up to 12 months.
The duration of the period of keeping office positions through the envisioned legal deadline can lead to misuse of public positions, the report notes.
“Maintaining positions with task guides for a longer time than the previous legal deadline risks holding various positions by those who do not meet the required/determined criteria for adequate positions”, the audit report says.
In paragraph 3, 4 and 5 of Article 35 of the Law for Public Officials is defined as a period of time that a public official can maintain the position of a task officer and points out that any decision taken after the set term is illegal.
“3. The official/public one could not be appointed as the task's objectant longer than six (6) months. When the position cannot be met within the six-month term, this deadline could last at the most for six (6) more months. 4. Free position cannot be replaced by task seeker for longer than the deadline set in paragraph 3. This article. 5. Any decision taken by the task officer, following the deadline set in paragraph 3. of this article, is illegal”, said in this law.
According to the ZKA report, meeting positions with regular working staff has been one of the recommendations given in 2023, which were not addressed. The report says the number of task makers remained the same until the end of 2024.
In the face of these deadlines, the ZKA found that the presidency has made excesses in the value of the framework contract for “Air transport services”.
If the value of the contract on the allowed rate is exceeded, the contract should be automatically terminated, according to Article 54 of the Public Procurement Act.

ZKA found that the presidency acted contrary to this regulation, which requires the contract to be immediately terminated in cases where 30 per cent of it is exceeded.
For a contract worth 120,000 euros, during the audit, we have concluded that the ZPRK has made supplies worth 211,404 euros, exceeding the contract's value of 55,404 euros on the allowed rate, 30 percent. This situation has come as a result of inadequate organisation by responsible persons involved in organising the second edition of the International Forum for Women, Peace and Security (bilta-Transport for official travel abroad), where the number of participants was very high while all planning was done based on the expenses of the first edition”, the report said further.
According to the ZKA, overcoming the value of the contract on the allowed rate could influence the budgetary organisation to enter unplanned financial obligations, so it recommends that the secretary general make sure that responsible officials constantly monitor the performance of contract implementation in order to prevent supply exceeded.
