The prosecution had claimed that Thaci continues to pose a risk to escape, as he is aware of the serious charges confirmed against him. They also support this argument with the fact that the prosecution's case is over and that Thaci already has full knowledge even of the evidence against him.

The prosecution had also claimed that soon Thaci would have sensitive information about witnesses and evidence that would present the victims' protection. Additionally, Thaci's having an indictment for obstructing procedures, according to the Prosecutor, increases his motive for him to flee.

While Thaci's defence, represented by lawyer Luka Misetic, has said neither the judge of the preliminary procedure nor the court has ever ascertained there is danger of Thaci escaping justice.

In this regard, the court has said that the prosecution is constantly repeating arguments that were previously considered and refused.

As for the new prosecution's argument, which Thaci will have significant information on witnesses to protect the victims, the court stressed that it is not a convincing argument to support claims Thaci is at risk of escaping.

According to the court, this argument might be more appropriate to consider in the part of obstructing procedures.

As a result, the court has said there is not enough information that Thaci can flee from justice in this phase of procedure.

At the point of obstructing procedures, the prosecution had said Thaci poses such a risk based on the general climate of intervention of witnesses in Kosovo.

In addition, the prosecution has stressed that the outcome of their case increases the risk of stumbling, as the accused has full knowledge of the issue and witnesses can be exposed to risks.

“The ZPS also stresses that sensitive information has been revealed to the defence, including the accused, increasing the risk of exposure to the public and damaging witness protection in case of release”, the decision said.

The defence had rejected the defence argument, claiming that the risk of obstructing procedures should be reduced over time and with the outcome of the prosecution's case.

The defence has also argued that witnesses who expect to call the victims' defender are international experts and not sensitive witnesses, so there is no danger of interference.

The court has said that by relying on the fact that charges Thaci has attempted to undermine justice, his release would not be in line with effective witness protection.

As a result, it was concluded that Thaci poses a danger to prevent the continuation of the TSF procedures.

The prosecution had indicated that Thaci continues to pose risks for committing other crimes, including against witnesses who have given or may give evidence in later stages in the case.

The court has recalled its previous findings, that the danger Thaci may commit other crimes continues to exist.

“Flyking Body stresses the fact that judgment on this issue is ongoing, that sensitive witness identities are revealed for Mr. Thaci, and that any danger to further committing crimes should be avoided”, the decision said.

The court feels that no alternative measures, including parole, suffice to ease the existing risks of this process. As a result, Thaci's detention was ordered to continue for another two months.

Meanwhile, on April 15th 2025, the prosecution has announced that it has completed presenting evidence in the case.

The Specialised Prosecutor's Office, on September 30th 2022, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, which consists of ten points on charges, where the latter are charged with war crimes and crimes against humanity.

On April 29th 2022, the Specialised Prosecutor's Office had handed over a amended indictment to Hashim Thaci, Kadri Wessel, Rexhepi and Jakup Krasniqi, where four indictees have committed war crimes even in Gjilan, Budakov and Semtish.

On November 9th 2020, in their first appearances, Hashim Thaci's Jakup Krasniqi has been declared innocent of the charges placed on them. Wessel has also been declared in his presentation on November 10th, as has Rexhep Selimi on November 11th.

The Act on Hashim Thaci, Kadri Veselin, Rexhep Selimit and Jakup Krasniqi is confirmed on October 26, 2020
