Tests used in the testimony of expert Marek Gasior are accepted

In the court case against former KLA leaders in which Hashim Thaci, Kadri Veselini, Rexhep Selimi and Jakup Krasniqi are taking the decision to accept some documents that have been used during questioning of witness Marek Gasior on January 27th 2025.

The decision on these documents was made on May 27th 2025 by the chairman of the court, Charles Smith III, reports the “Justice Trust”.

The status of an expert in this case was given by the court through a decision made on December 16, 2024.

According to the Court, some of the evidence does not have an Albanian translation for what the Prosecutor commissioned him to secure translation shortages without delay.

For documents in question, the SPS claims to be reliable and their provative value is not surpassed by any prejudice.

The defence has expressed itself against accepting evidence drawn up by experts from third parties that are not tied to the SPS witness list through any expert witness.

They also object to accepting associated stem material with the reasoning that some of the articles should not be accepted because they fail to meet the conditions that fall on the rules for accepting documents on material evidence. It's basically about autopsies that haven't been performed by the witness himself, autopsies that have counterintelligating information and documents that are outside the area of this witness's expertise or that have nothing to do with his evidence.

The judge's “The Judicial Body notes that the E04826 Experts' Report contains information, among other things, about the circumstances of death or mistreatment of victims in the locations mentioned in Aktakuza, including Bajgor/Bajgora, Lapusnik/ Lapushnik, Drenoc/Drenovac, Malisheve/Malševo and Klecka/Klečka. The Judicial Chamber is due to the conviction that the report by the S04826 expert is important for charges in the indictment”, it says in the decision, adding that they are convinced that this report is reliable prima facie, and in addition, has provative value.

The trial court in his decision has said that some of the evidence and stem materials are evidence of exhumation, anthropogic evidence, DNA and similar ones that fall directly into the area of witness expertise. But these evidence did not mention in the report and the expert, and therefore rejected their admission.

The rest of this source material, however, is made up of autopsy reports and documents related to the death and mistreatment of alleged victims mentioned in the witness report or related to documents already referred to in that report.

As a result, this remaining source material has been accepted in material evidence because it had provative value that was not surpassed by prejudice in view of the possibility that protection would confront the witness with the content of these documents.

In addition to such material, many other materials were accepted in material evidence that were described as important to the matter.

Meanwhile, on April 15th 2025, the prosecution has announced that it has completed presenting evidence in the case.

The Specialised Prosecutor's Office, on September 30th 2022, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, which consists of ten points on charges, where the latter are charged with war crimes and crimes against humanity.

On April 29th 2022, the Specialised Prosecutor's Office had handed over a amended indictment to Hashim Thaci, Kadri Wessel, Rexhepi and Jakup Krasniqi, where four indictees have committed war crimes even in Gjilan, Budakov and Semtish.

On November 9th 2020, in their first appearances, Hashim Thaci's Jakup Krasniqi has been declared innocent of the charges placed on them. Wessel has also been declared in his presentation on November 10th, as has Rexhep Selimi on November 11th.

The Act on Hashim Thaci, Kadri Veselini, Rexhep Selimi and Jakup Krasniqi is confirmed on October 26, 2020. /Periscopi/
