Kosovo's Telekom says the Commercial Court has approved the company's complaint regarding the final procedure issues in the case of “Dardaphone.net Z-Mobile”.
It was announced in the report that the Court has ordered the return of about 4.4m euros, which according to Telekom had been illegally withdrawn from the company's accounts and carried to private accounts and later to “Dardafon”.
It is also said that the Court has found that the estimate of interestd has been made by a third subject, not legally authorized, committed by the registrar himself, not as the Law for Final Procedure requires.
“In its reasoning, the Court finds that the estimate of the suicides was made by a third, not legally authorised subject, committed by the Master himself, not as the Law for Independence Procedure requires. As a result, this estimate has been declared invalid and legally unacceptable, revealing serious procedural violations in the completion process. During the completion phase, the owner has been informed by Telekom of the violations he was committing, constantly urging him not to take action beyond legal competencies and informing him of their consequences. Master Flamur Bogay has not considered these requests and reports, nor has he responded to them”, says the statement.
Telekom has warned that it will follow all legal procedures against the owner.
