Lawyer Qerkeyni has said that the administrator of Specialised Chambers has a mandate to negotiate agreements with third states where convicts with fine form sentences could serve sentences in those countries.
The first agreement of this nature, as I know it, is this agreement signed between the Specialised Chambers and Belgium. According to this, Belgium is forced to accept all those persons who are sentenced by the Special Chambers to an act of formal form. Of course, the agreement contains other details, which showed me a very interesting detail, because in the agreement itself writes that the people who will be punished by the specialised rooms and serve sentences in Belgium cannot be pardoned according to the Law for Forgiveness of the Republic of Kosovo and they can be released before holding the sentence only on the basis of the decisions of the Special Chambers”, he said.
On the other hand, Qerkini has said that Specialised Chambers have wanted to ensure that Belgium will not implement any pardonary decisions the president can make.
He has also talked about the decision of Specialised Chambers, where a plea for protecting those accused of parole has been rejected.
I am surprised by this decision, because the moment the case was passed before the court, the court has never ruled on the ongoing detention rulings that there is no danger of escape, it has only found that there is danger to influence witnesses. However, we know that the prosecution has completed its case, therefore no witnesses to invite, and if the only procedural danger has been the risk of influence on witnesses, there is no such danger at this time as”, Kerkin said among other things.
