Resumption hearing, prosecutor: How do we end this subject?

Due to the absence of indictee Progress Prvetica, it has failed to be held Wednesday at the Constitutional Court in Pristina hearings against him, Arber Krasniqi, Iliran Hysenaj and Sahit Mataj, charged by the Special Prosecutor for falsification of votes in the 2021 elections.

Regarding the absence of Pjetica, case judge Vesel Ismaili said his lawyer, Halit Shalyan, through the presumption of June 2nd 2025, has announced to the court that the accused could not be present at this session, reports “Battle for Justice”, broadcast Periscope.

According to the judge, the court was announced that the accused would travel abroad for the health reasons of a family member. And if accused Pjetica is missing again, he asked attorney Shaljan to inform his client of the consequences in case of missing the next session.

Regarding this session's failure, prosecutor Ilir Morina voiced concerns about managing this court process.

“We as the Prosecutor are concerned with the way this case is handled and the postponement of sessions without any legal reason”, prosecutor Morina said.

He said he doesn't know how this case will get by this way of his proceedings.

Similarly, the prosecutor demanded that the trial be carried out in the absence of accused Pristina, as his lawyer, Shaljan, was present.

The lawyer, on the other hand, said that he leaves it to the Court to decide, adding that he has not taken an opinion of the situation.

The court later rejected the prosecutor Morina's proposal for development of trial in the absence of indictee Pristina, arguing that legal conditions have not been met.

Finally, the session was interrupted to continue during September. In contrast, Witnesses given at this session were Witnesses No. Letty and Dardan Stublla.

The March 12, 2025 and April 22, 2025 sessions have also failed.

Otherwise, on November 13, 2023 The court had phased out the criminal procedure against indictees Granit Halilaj and Dardan Gashi after the same had entered into plea agreement.

Therefore, to Halilaj on November 14, 2023, even the declaration of the indictment has been made, having been sentenced to 1 year in prison on bail for the counterfeit criminal act of voting results.

Gashi has been sentenced to 12 months in prison on bail so that for 12 months he does not commit any other criminal act, as well as a 12-month supplementary sentence banning the practice of public administration.

As for Shala, Krasniqi, Matajt, Pjetica and Hysenaj, the judicial process continued. At the February 20th 2025 session, the Court has phased out the procedure for former President Haxhi Shala, as the same is being tried in another court trial at the Special Court in The Hague.

The Special Prosecutor of the Republic of Kosovo on December 30th 2022 has filed charges against former President Haxhi Shala, Arber Krasniqi, Sahit Mattajt, Pristina Progress, Ilirjan Hysenaj, Granit Halilajt and Dardan Gashi, who are accused of forging voting results for early elections for the Republic of Kosovo's Parliament.
