The PDK sues ZRE, at the Foundation Court: Canceled Energy Market Liberalisation Decision

The Democratic Party of Kosovo, remaining loyal to its responsibility to protect public interest and the rights of the country's citizens and businesses, has surrendered today to the Constitutional Court in Pristina the indictment to annul the decision to liberalise the electricity market in Kosovo.

This decision, taken in the absence of a fair, legally based and comprehensive process, has already begun to produce serious and irreversible consequences for over 1,300 local businesses and over 140 thousand workers of these companies. The effects of this decision are seriously jeopardising the country's economic stability through price hikes, promotion of inflation, and the threat of bankruptcy of a large number of businesses.

In addition to the main indictment, The PDK has also requested from the tribunal the appointment of a security measure -- the immediate suspension of the implementation of this decision -- in line with Article 100 of Law No. 08/L-182 for Administrative Conflicts, to prevent damage being caused every day.

In this process, The PDK has acted as a fully legally quoted party in defence of the collective interest of Kosovo citizens and businesses. The decision of the Energy Regulatory Office has violated not only the legal rights of consumers exceeding the 10m-euro circulation annually or employing over 50 people, but also directly hit the economic interest of all citizens of the Republic of Kosovo.

The preliminary procedure followed near Z The RRE has fully confirmed our current concern: this institution has not issued any final administrative decision on market liberalisation, but has used a simple announcement to impose a serious obligation to the private sector. This action is deliberately done, aimed at avoiding judicial control.

In line with the principles of the rule of law and based on arguments and concrete evidence, The PDK has taken all legal steps needed to initiate this judicial battle, in the interest of the public and the law.

We expect that the court will objectively assess our request for the appointment of a security measure and prohibit the implementation of this decision until it finally is decided on its legality.

At the same time, we welcome today's decision by the Commercial Court, which approved a private company's request for the suspension of this decision. This decision provides an important precedent, and we hope that it will be confirmed in all judicial instances, serving as the basis for unifying judicial practice in similar cases.
