“We are here to express our concern for violating human rights for The Hague tribunal. Kosovo has supported the establishment of the Special Court in the belief that European standards will be forwarded to action, yet the process that has been under way for more than four years has been far from European standards. The violation of the Kosovo Constitution, the European Convention for Human Rights, is alarming.

Today when the process is coming to an end, when the prosecution has closed the evidence's writing, these violations have to be identified, a voice raised against injustice. All these violations, due to the denial of fundamental rights, unwarranted delays in the process, indicate that the process has deviated from the path of fair and impartial judgment. We seek to reconsider the practices of this court, ensure that the Constitution is respected. The process will be conducted on the basis of justice, not of prejudice”, he said.

 

 

We call on financial states to assume institutional and moral responsibility to ensure that the tribunal's work is in line with fundamental principles of justice, not influenced by political interests or agendas. This is not an attempt to intervene in justice, but a requirement for justice to be implemented in line with the principles of European standards”, Tashlo said further.

He warned that in the future, if there are no changes, the option for protest remains open.

We usually have civic mechanisms to respond to any injustice, the option is protest. Every chance is open, see if something's changing for the better, the whole path is wrong. Hopefully these violations will not continue to occur, the options of a civic response are open”, Tasholli said.

Constitutional Law Professor, MP Progress Gruda, has enumerated violations.

This principle is part of the Constitution and the Convention on Human Rights. This was done on behalf of autonomy, against judicial rule”, Gruda added.

It is important that Kosovo society, institutions and anyone refrain from interfering with the work of the Court. I respect this sacred principle, that courts should be free and independent. The court must preserve its independence. But no free European society is denied by the” debate, Gruda's Progress concluded. /Periscope/
