So, after reviewing the evidence found in the subject's papers and defence claims, the Foundation has estimated that the indictment is based on legally provided evidence and there is no evidence that may be unacceptable or that has been taken contrary to the legal provisions of the KPPRK and that the indictment has sufficient evidence for the criminal work the accused is charged with.
“... Such a claim is unfounded because there is a well-founded doubt that the defendants' actions form elements of the criminal act for which they are accused and that based on evidence collected during the investigative procedure”, the decision says.
According to this Court, defence cases are actual issues that will be considered, confirmed, or refused during the trial review, where the accused's guilt or innocence will be proven.
“For now, the court cannot credit the evidence found in the subject paperwork, which at the moment supports the suspicion that the defendant has carried out the criminal work for which he was commissioned by the Founding Proquiory in Pristina, but the circumstances in which the criminal work was carried out is an issue that will only be considered after examining any separate evidence and all together in judicial review in accordance with the legal standard of KPK”, the decision is further said.
While, in terms of defence claims about the reliability of the defendants ' statements and claims, the Foundation stresses that at this phase of the procedure it cannot be issued to the pro-testing power of evidence, nor in contradictory evidence, and that the same present provative tools in judicial examination and their credibility can only be assessed after hearing them in court.
Thus, the Court has rejected the defendant's plea for dropping the indictment and declaring unacceptable evidence, perceiving that there are no circumstances that exclude criminal responsibility, there is no preamble of prosecution, a minister or pardon, and that there is sufficient evidence proving the well-based suspicion that criminal acts were committed for which the accused was charged.

Unlike the initial session of April 22, 2025, Prince Valentino Corleone has been declared innocent in connection with the narcotics trade charge.
