Driver's license, 10 suspects left in house arrest

According to Apel's decision, provided by “Justice Vow “, the first degree has acted correctly in the case of the house arrest measure, as there is doubt of believing that if the defendants are found in freedom, they will leave in order to avoid criminal responsibility.

Apel has stressed in the decision the burden of criminal acts linked to corruption during the exercise of official office, as defendants allegedly earned money through the exercise of official duties, as well as the fact that there is danger that criminal acts can repeat.

So according to Appeals, the first straight degree was when it set the measure of house arrest against the defendants.

The “Justice Vow” reported on May 30th that the Constitutional Prosecutor in Pristina has requested from the Constitutional Court in Pristina the appointment of the detention measure for suspects: Drilon Ahmeti, Ekrem Ahmeti, Emesh Ahmeti, Avni Abdel, Sabri Arifaj, Sadri Sutaj, Kamer Shabanaj, Africa Tocani, Naim Mureli and Leutrim Abdejli, who were arrested in the police action on May 29th under suspicion of driving pins.

During a police operation in Pristina, Gjilan and Gjakova, police arrested 11 suspects in patent abuses. The prosecution had sought detention for 10 of them. But, the Constitutional Court in Pristina rejected the request for detention, and suspects were assigned the measure of house arrest.

According to the prosecution, Drilon Ahmeti, Ekrem Ahmeti and Emesh Ahmeti, during 2024 and May 28th 2025, in Pristina and Viti-Gnjilan, Drilon and Ekrem Ahmeti (babe and son) owners of the car “Drilon” Shrik and “Drilon” in the year, in co-ordination with defendant Emsh Ahmeti, to equip directly or indirectly with drivers' license have demanded and accepted money at the value of 600 euros from the candidate for a driver's license -- now E.K., with the promise they are able to exercise direct influence on the driver's license co-ordinator's decision in Gjilan-Avni Abdali.

With this, the defendants are suspected to have committed criminal work “influence enforcement” by Article 424, par.1 and 2 of the Criminal Code, regarding Article 31.

At the second point of the request, defendant Drilon Ahmeti is suspected that from December 18th to December 28th 2024, the owner of the car “Drilon”, contrary to the legislation in power, has enabled different persons/cadidas to be equipped with driver licenses without being able to do so, and they have done so by taking money from candidates.

It says that some of that money has been given to the examiners/forests to pass on to the appointed candidates. The defendant Drillon, without even being present (without being present in the car) and being aware that the candidate at that time was not in Kosovo, registered his driver's license and completed the file with false signatures that the candidate had heard the lectures and also signed for candidates as having performed practical driving hours.

With that, Drilon Ahmeti allegedly committed criminal work “The special cases of counterfeiting documents” by Article 391, par.1, Penal Code 1.1 points.

According to the third point of the request, defendant Emesh Ahmeti is suspected that during 2024 until May 28, 2025, in Pristina and Gjilan, in the quality of senior official for monitoring the Department of Patenta Shofer in MMPHI, using official office exceeds its competencies in order to benefit any benefits for himself or the other person. He allegedly helped his family (Erkremin-son of his brother) benefit from work in the car “Drilon” shpk and “Drilon”- in the year, so that the EU candidate, and other driver's license candidates, pass the theoretical and practical test by giving money to the driver's driver's license co-ordinator in Gjilan, defendants Avni Abdilani.

With these actions, defendant Emesh Ahmeti allegedly committed criminal work “The use of official position or authority” by Article 414, par.1 of the Penal Code.

At Dosje's fourth point, Drilon Ahmeti, Ekrem Ahmeti and Emsh Ahmeti are suspected that during 2024 until May 28th 2025 in Pristina and Gjilan, co-ordination, directly or indirectly, they give money to the official person not to act in accordance with his duty, respectively co-ordinator Avni Abdejli, in order for drivers' candidates to give the theoretical and practical test by giving bribes.

With this, the three defendants are suspected to have committed a criminal act “The bribery code” below us 422, par.1 over Article 31 of the Criminal Code.

At its fifth point, Avni Abdelili allegedly took bribes from defendants Drilon, Ekrem and Ems Ahmeti in the quality of the driver's license co-ordinator in Gjilan, deliberately and by using official office, allowing candidates to obtain the driver's license in exchange for money.

With that, Abdely allegedly committed the criminal act “The use of official position or authority” has come under 1414, par.1 of the Penal Code.

Always according to Dosje, at the sixth point, Avni Abyli is suspected that during the year 2024 until May 28, 2025, in the quality of the driver's license co-ordinator in Gjilan, contrary to the Law on a direct and indirect driver's license, he requires and accepts a gift, money for himself, so that he can enable candidates to give a theoretical and practical driving test in exchange for bribery/money.

According to the prosecution, he has accepted money from defendants Drilon Ahmeti, Ekrem Ahmeti and Ems Ahmeti to transfer candidate E.K., and other candidates to the theoretical test, while for the practical part he has promised to help him when he is appointed the term by the competent body.

With that, the defendant Abdelin allegedly committed the criminal act “taking bribes” from Article 421, paragraph 1 of the Penal Code.

The defendants, on the other hand, Naim Murseli and Afrem Tocani, at the seventh point are suspected that during 2024 to May 28, 2025, defendant Murseli, owner of the “Naim” in Podujevo, co-chaired with defendant Tocani to equip candidates with driver's license, have acted in opposition to the Law on a driver's license.

Specifically, it is said that directly or indirectly they have requested and accepted money from the N.N. people, with the promise that they are able to prepare documentation at the Medical Centre (X) and the Auto Candidate School “NATION” as well as direct influence on the decision-making of the official person, competent for the driver's license in Podujevo.

With this defendant Naim Murseli and Africa Tocani are suspected to have committed criminal work in co-ordination “the exercise of influence” by Article 424, par. One and two regarding Article 31 of the Penal Code.

Also, at the eighth point, Africa Tocani is suspected that during the year 2024 to the date of arrest, the quality of the official person at MMPHI, using his office or official authority exceeds his competences in order to benefit either himself or the other person.

“So that he used authority and helped the owner of the car “Nimi”, defendant Naim Murseli take advantage of his driving school on Auto in Podujevo, so that patent candidates pass the theoretical and practical test contrary to the driver's license bill, asking for money from driver's license candidates, and advising them that, you must hand it over to NNN. With this, defendant Africa Tocani allegedly committed criminal work “The use of official position or authority” by Article 414, paragraph 1 of the Penal Code.

In addition, Africa Tocani and Naim Murseli, at the ninth point of Dosje, are suspected that in the same period in co-ordination, directly and indirectly they give money to the NNN. The official driver's license official in Podujevo who does not comply with official duty so that patent candidates can give the theoretical and practical test by bribing.

With this, they allegedly committed the criminal act “Bribery Code” by Article 422, par. 1 connected to Article 31 of Penal Code.

For the same period, according to the 10th point of the Prosecutor's Office in Pristina and Gjakova, defendant Sabri Arifaj, as owner of the “car. KADER” in Gjakova directly or indirectly gives to examiners so that driver's patent candidates give the theoretical and practical test.

He's allegedly committed the criminal act “Bribery District” by Article 422, par.1 of the Penal Code.

Also, at the 12th point, Arifaj is suspected of illegal possession, so that during the control of the Kosovo Police in his car, the defendants have been found a short weapon, which is not known how long he owns it.

On the other hand, at 11th point, Sadri Sutaj allegedly in the quality of the driver's license in Gjakova, deliberately using official duty and official authority in exchange for bribery has enabled 52 automotive candidates “Kader” in Gjakova to pass the test, instructing and showing questions of the driver's license responses, reports the “Bettim for Justice<3>.

According to the prosecutor, Shabanaj has accepted specific amounts of money from autoschool candidate “Kader”, so he has instructed the examiner which candidates should pass the theoretical and practical test, and looking for accounts from the examiner- defendant Sadri Sutaj about why one candidate of the Cargoll “Calder<3> has passed the theoretical test and not.

With that, Shabanaj allegedly committed criminal work “The use of official position or authority” by Article 414, paragraph 1 of the Penal Code.

The defendant Leutrim Abdel, at 14th point, reportedly in the quality of the examiner at MMPHI, using official authority exceeds his competencies in order to benefit himself or the other person, so he promised and helped candidates pass the practical driver's license test, and he has done so in exchange for monetary means in various amounts.

For this, he allegedly committed criminal work “The use of official position or authority” by Article 414, paragraph 1 of the Penal Code.

Also, he allegedly accepted money from a potential candidate for obtaining a driver's license from the “D” category. According to the prosecution, this is saying that if he is interested in being equipped with this patent category, he could do the same if he gave the amount of 600 euros.

With this defendant, allegedly committed a criminal offense “taking bribes” from Article 421, paragraph 1 of the Penal Code. /Periscope/
