Commercial Court ruling is first step towards preventing injustice in energy sector
I welcome the Kosovo Commercial Court's decision, which on June 18th 2025 has approved a business requirement for suspending exemption from the universal service. While it comes to an individual case, this decision sets important precedents by questioning the entire process imposed by ZRE for crossing the so-called open market, which only as such does not exist.
On the other hand, we regret that ZRE rather than reflect, has chosen to go public with an arrogant statement, presenting the decision as trivial and trying to downplay its impact. This shows a lack of responsibility and disrespect for the decisions of justice bodies and the continuation of a completely wrong, irresponsible and non-transparent policy. But, ZRE needs to know the impact of this decision because if a business has acquired the right to temporary suspension due to lack of equal conditions and planning, then all other businesses excluded from the universal power supply service are in the same situation and have the same rights. The decision is not simply “technical” or “idvidual” It is a clear indication of a failed and unprepared process by the government-backed ZRE.
I expect that:
- The Commercial Court considers the other lawsuits filed by associations and businesses as priority, there are currently dozens of such indictments, where hundreds of businesses excluded from the universal supply are headed towards courts, demanding a transition period and government support.
- The Commercial Court also urgently handles the decision to increase the price of electricity for family consumers, a decision that directly burdens family economies and small businesses.
- Justice organs, including Special Prosecutor, start detailed investigations into the so-called <x0-mefi energy”, the way import and export of energy managed, the sharing of tenders in KEK and the impact of interest groups on energy policies.
We cannot have market liberalisation without initially ensuring that we have real competition without transparency and protection of consumers and businesses. We can't have regulatory institutions and decision-making organs using the <x0-market” as an excuse to raise prices and serve the interests of energy traders.
