The American Economic Oda in Kosovo reiterates its deep concerns regarding the implementation of energy market liberalisation, in light of recent judicial decisions suspending the execution of decisions issued by the Energy Regulatory Office (ZRRE). In at least two separate cases, Kosovo's Commercial Court has ruled in favour of individual companies opposing the ZERE decisions, thus suspending their implementation until making a final decision.
What is particularly important is that two different judges, in separate court cases, have reached the same conclusion, suspending the ZERE decisions pending final judgments. This consistent judicial approach reflects concerns about the potential impact of these decisions on the market, and as such cannot be ignored as casual or specific in one or two cases.
Although these commitments currently apply only to a limited number of companies, their implications extend much further. Continued implementation of the ERE liberalisation measures, while two companies currently benefit from suspendeds ordered by the tribunal and others remain pending judicial action or launching legal procedures, creates an environment of judicial uncertainty and economic discrimination.
The American Oda strongly believes that reforms, including those in the energy sector, should be governed by the principles of justice, predictability and equal treatment before the law. Under these circumstances, the American Economic Oda in Kosovo called on the Energy Regulatory Office to immediately suspend the implementation of controversial liberalisation measures until the judiciary gives clarity through final decisions on all relevant complaints.
Only a fair, transparent and fully functional market can offer a steady road forward, where all companies, regardless of size or legal capacity, act under equal conditions.
