Witnesses Murat Kabashi and Elmi Gashi, both from the village of Mohlan, the Suhareka municipality, confessed on Monday at the Constitutional Court in Pristina about the beatings they had experienced during 1998 and 1999 by war crimes indictee Shaqir Lutvia in Prizren prison. Initially, witness Kabashi said he was in coexistence and under difficult economic conditions with 22 families and that one day he had the need to go to town to buy food.

According to Kabashi, with Suhareka returning to the village of Mohlan, where the village's ambulance was, Serbian police had been deployed, and there they had arrested him on the grounds that he must issue a statement.

After his arrest, Kabashi said he had been sent to the Prizren prison, where, according to him, he was placed in room 36, where he was also the accused Lutfia.

The Witness said that he had been asked if he had been on guard during the war and that he said that he had denied and had not responded to what he later said that they had started beatings that had lasted two days.

There's a chair in there, and I've mentioned it to the prosecutor, and he's been hanging in there, and as long as he can. That day, I was taken to a field in that little prison, and the next day I started abs at the same time, a 3-4-hour apet has lasted on its own for my pet. They also have a friend, I don't know his name, and he's been practicing violence against me”, Kabashi said.

Kabashi also explained that the accused Lutvija has managed to identify on the basis of his eyemark, but that his name and surname did not know.

Always according to the witnesses, police investigators had presented him with several photos and that on their basis he had identified the accused Lutvija.

Later, the hearing continued with witness testimony, Elmi Gashi, who, to accuse Lutvija, said that during the time he was sent to Prizren Prison, he was referred to as “Chief” and “Luta”, and his name did not know.

Gashi said that the violence against him was exercised by prison employees at his own command by the chief, because he refused to plead the questions he had been brought, which, according to Gashi, was completely false, so he did not want to confess.

According to Gashi, at the order of “chief” -- referring to the accused Shaqirir Lutvija -- was beaten in all parts of the body, except for the head, which the accused himself, he says in some cases he had committed violence.

"Initially, with their hands regret and questions usually have been... not that I've agreed but that they haven't been true. And when they saw it, they might not be getting enough of me and they told me they had my feet up and they started hitting my legs and on their backs, except on their heads. They started being tortured as long as they wanted to, once they saw that it was enough and they took me to the room”, he said.

Gashi also said the beating had taken place over six days and that he was beaten once a day, but in some cases twice again. He said that every time he knowingly went to room number 36, but that for his return to the cell it was unconscious because of his beating.

The Witness claimed that some photographs were offered to him and that he had identified the accused Lutvija and him through them on the basis of a mole under his eye, as well as the fact that for six consecutive days he was involved in his persecution.

And I never saw, I could see, I could draw, on top of all of this is because I never forgot my face, and I've reminded my lawyer, and I've told him, and I'm going to repeat with him, I'm beating down the Shaqa from Saturday to Thursday once a day, yes, but two times, you've never forgotten, and today I'm suffering from his masons<1>, Gashi said.

Always according to Gashi, because of the persecution he had received, was a health problem.

“15 straight days I've urinated blood”, Gashi said.

He also said that the accused's name and surname did not know, but only after he was arrested and taught.

In the end, witness Gashi, with the court's permission, displayed his left leg at the end, where he felt he was hurt by the abuse he suffered and that others had caused this injury in the presence of the accused Lutvia.

For this, the accused's lawyer, Jovana Filipovic, said they oppose such a request by witness Gashi, as she has not testified that the injury occurred during October 1998.

Later, the session ended with the conclusion of Gashi's testimony, as, according to the court judge, Metom Krasniqi, witness Sefer Ejupi has not been submitted to give the testimony, even though he has accepted the invitation regularly, he has not reasoned.

Parasely, the trial began again after the change of court member, where instead of Judge Shyti, Judge Violet-Naman-Haira is a member, and that with the reconciliation of the parties in the procedure the actions taken so far were found read.

At the initial session, held on September 17, 2024, Lutvija was acquitted of being charged.

The Special Prosecutor of the Republic of Kosovo on September 4th 2024 has filed charges against Shaqir Lutjija, who is charged with the quality of inspector and police at the Prizren Police Station, individually and in co-ordination with other persons of Serbian police forces during the 1998-1999 period in Prizren, during wartime in Kosovo, has been practicing the depressive measures of murder, arrest, beating, torture and inhuman treatment.

The Actakuz says that according to witness testimony: Murat Kabashi, Elmi Gashi, Sefer Ejupi, Vehbi Velija, Kemajl Kolari, Uke Kolgeci, Haxhi Gashi, Safet Gashi, Hasan Shala and Arsim Zuba, accused Lutvi from 28 September 1998 to 7 October 1998, in association with other members of police forces, have undertaken a campaign for their arrest in Prizren prison, in the quality of the Albanian national population, among them: R.J., and the tall ones.

All in accordance with the indictment, Serb forces after the arrest were sent to the Prizren Police Station, on whom the accused Lutviija, along with the other defendants, in the quality of the inspector of this station, questioned the injuries and during the interrogation process have beaten them with boxing and kick, with other strong means and other methods of inhuman treatment.

In the indictment, Lutvija and other defendants reportedly used electric power tools, which they placed on their hands and on their genital organs, with céçkarst as a result of this R.J., had died, while Murat Kabashi, Elmi Gashi, Sefer Ejupi, Vehbi Velija, Kemal Kolari, Uke Kolgeci, Haxhi Gashi, Safet Gashi, Hasan Shala and Arsim Zuba suffered serious bodily injuries.

With this, Lutvi is accused of committing a joint criminal act “war crimes against the civilian population” by Article 142 concerning Article 22 of RSFJ's Criminal Law.
