The organisation's chairman, Jahir Bata, said material damage has been enormous and that for 17 years they are seeking justice for war victims in order for Serbia's government to compensate for the damage.
He criticised judicial institutions for failing to implement laws and said requirements are being deemed unfairly unacceptable.
There's been a lot of bad things, the bar has destroyed us. The houses destroyed us, the tractors took them from us. Everything we had was destroyed. Since 17 years we have been working day and night for all parties damaged with the quality of war victims, with one single against the government of Serbia for damages compensation. Today it's the thirteenth time we deliver the files here. Regular courts and the Supreme Court are not implementing the relevant laws for which they are called and are competent”, Bata reported. Bayta stressed that the Constitutional Court has the obligation to harmonise decisions with European Court for Human Rights standards and that more than 110 files have been handed over so far.
The Constitutional Court is not considering the requirement for assessing the constitutionality of the Supreme Court decision. Otherwise he will find that regular courts have committed violations. The Constitutional Court is violating the constitution. Our courts, including the Constitutional, have no right to do so but have an obligation to comply with the decisions of the European Court of Freedom and Human Rights. We have over a thousand files, over 110 files that were handed over to the Constitutional Court of Kosovo, the answer is the same”, he concluded.
We remember that about a thousand motions have been drafted by this organisation and handed over to the courts, almost all of Kosovo municipalities, but all of them have been rejected by courts on the grounds that they cannot sue another state. /Periscope/
