The Kosovo Judiciary Council (KGJK) has ruled that all indictments exercised by public officials against the Republic of Kosovo Assembly, with which compensation is required on behalf of the work experience under the Constitutional Court's act of Law on Salaries in the public sector, be registered only physically.
The law on salaries in the public sector had reduced the additional percentage of work experience for the first 15 years from 0.5% to 0.25%. But, after the case was sent to the Constitutional Court, the latter had imposed the decision on the decision to take all actions until August 1st 2024 to return the labour payment level to at least 0.5%, reports the “Justice Vow bet”.
Because the Assembly did not comply with the Constitutional Court's Law on Salaries in the Public Sector Act, about 2 thousand indictments have been filed in Pristina in one day, prompting the judicial system to be charged.
“All new indictments with counter-compliance objects from the working relationship, on behalf of trying work (from 0.05 % to 0.5 %) under the Constitutional Court's judgment of January 23rd 2024, regarding the assessment of the No, 08/6 for salaries in the public sector, will be registered only manually in the physical registry of the contextal procedure with the CC.rs 01/20255>, the KR decision said.
In the argument of the decision taken on April 29, 2025, it is said that to this establishment of the Council has come after dealing with an extraordinary situation that directly affects the efficient and effective management of work in courts.
According to the KDR, that's why it's decided at this stage, all these lawsuits will be recorded only manually in the relevant physical register.
The KCJ stresses that the decision is made based on the constitutional and legal mandate the Council has linked to judicial administration, respectively, the efficient functioning of courts.
On March 20, 2025, The IKD had organised discriminating meetings with representatives of political parties elected in the IX legislature, with representatives of public sector unions and representatives of civil society organisations.
The meeting was discussed for failing to implement the Constitutional Court's Court for Salaries Act in the Public Sector, and the report has been published under the heading: “The non-action of the Parliament violates the rights of 90,696 public officials and endangers the state budget”.
The report says that if the Parliament does not act and public officials are forced to address the tribunal, the potential in this case is that the courts will overflow with about 900,000 new materials, which will have to deal with one for one.
This situation would weigh beyond the subject judiciary. Apart from the judiciary, this situation would also damage the budget of the Republic of Kosovo, due to the obligation of paying procedural expenses. On the basis of a general calculator, 35,770,502 euros for procedural spending, without including legal interest and possible total expenditures”, was highlighted by the IKD./Periscope.
