One lawyer missing, hearing against two accused of fraud fails

Indictee Salih Zariqi said his defender has sent a report on his lack of health, reports “Battle for Justice”, broadcast Periscope.

However, such an announcement, case judge Adnan Kamberi, suggested that he has so far declined.

In the absence of lawyer Bogiqi, accused Salih Zariqi demanded that sessions be postponed.

So, in the absence of legal conditions, the session has been postponed for another date.

Otherwise, the Pristina Foundation Court had acquitted the two accused of fraud in February 2022. But, the Court of Appeals in February 2023, the case against indictees Salih and Lutfi Zariqi had turned into retrial.

The College of Appeals after reviewing the subject's paperwork as well as the alleged conviction has found and confirmed that the Constitutional Act is involved in essential violations, which make it countersed by the accuracy of the evidence that is contrary to itself and existing facts.

According to the indictment filed in September 2017 by Pristina Constitutional Prosecutor Salih and Lutfi Zariqi are charged that from February 10th 1992, and in the course of so far, they have conducted a civil procedure at the Foundation Court in Pristina. They are charged that with presenting false facts and with the intention of illegal property gain, co-ordination and preliminary agreements, they have managed to change the owner of a partnership in Pristina's former Communist Assembly.

The indictment says the defendant Salih Zariqi, following the drafting of the forged public document, namely the procession entitled “Zapisnik or Usmenoj Raspravi”, has used it as a real document, under which the number of T.r.64/04 act has been taken, and incompatible, by cadastral No. 2708/2, covering 47.48 gold from the former Municipal Assembly, has been passed on behalf of defendant Lutfi Zariqi.

Then, according to the indictment, the defendants, through these forged documents, have launched a controversial procedure at the Constitutional Court in Pristina, with the presentation of false facts, to cause material damage to the other person, in this case H.D. injury. This procedure continues to this day.

With these actions, Salih and Lutfi Zariqi are charged with co-ordinating criminal activity “Deception”, according to Article 335, paragraph 1, concerning Article 31 of the Criminal Code. /Periscope/
