Kosovo's Institute for Justice (IKD) has said the Kosovo Prosecutorial Council must respect innovations in the new KKP Law, which was published yesterday in the Official Journal and is expected to take effect within 15 days of the announcement.
The IKD has called on the KKP not to allow the violation of principles defined by the new law and to prevent its members from being replaced by new members, or transferred to the Special Prosecutor of the Republic of Kosovo with rapid procedures.
“The IKD seeks and expects the KPK not to allow under any circumstances that for the narrow interests of its current members, or members who have offered resignations, violate and violate the principles defined in the new law adopted by the Parliament of Kosovo and which has passed the provision of the Constitutional Court”, is said in the institute's communique.
Until the new Law's entry into force, the IKD has stressed that any action contrary to this spirit and the purpose of this law could be perceived as “-tensive to sabotage reform in the prosecutorial system and undermine law enforcement by preserving the practice of corporate composition”.
The IKD has estimated that the resignation of its member, Armend Zenelaj, just months before the end of the regular mandate, poses suspicions that “we have to do with co-ordinated resignations that try to sabotage reform in the constitutional system”.
Despite the fact that the new Law comes into force after 15 days, Mr. Zenelaj should not be replaced by any new member, so that the number of KKP members will gradually be reduced, as envisioned by the new Law. Over the period of two years, the KKP should not advance Mr. Zenelaj or any other member who resigns, because the eventual resignations offered during this stage until the entry into force of the new Law could be perceived as the KPK's attempt to extend the mandates according to the corporate composition”, the IKD estimated.
